Terms and conditions of the sale
1.DEFINITIONS
1.1 "Customer" means the party identified as the customer in this agreement to which UK GIFTS AND CARDS may agree to supply products in accordance with the terms of this agreement
1.2 "Products" means goods provided by UK GIFTS AND CARDS to or for the Customer in accordance with these terms and conditions
1.3 "UK GIFTS AND CARDS" means Stortford Hall Ltd of Unit A Bridge Works, Hall Green, Little Hallingbury, Bishops Stortford, Herts. CM22 7RP.
 
2.CONDITIONS OF CONTRACT
2.1 These conditions of contract shall not affect any statutory rights to which the customer may from time to time be entitled and which by law cannot be varied or excluded
 
3.ORDER ACCEPTANCE
3.1 All orders placed with UK GIFTS AND CARDS by the Customer for Products shall constitute an offer to UK GIFTS AND CARDS under these terms and conditions and shall be subject to availability of the Products by UK GIFTS AND CARDS authorised representatives
3.2 All orders are accepted and Products supplied subject to these terms and conditions only. No amendment of these terms or conditions will be valid unless confirmed in writing by an authorised representative of UK GIFTS AND CARDS
3.3 It is agreed that these terms and conditions prevail over the customer's terms and conditions unless these later terms and conditions are accepted by UK GIFTS AND CARDS in writing and signed by an authorised representative of UK GIFTS AND CARDS
4 DESCRIPTIONS
Our aim is to provide accurate and detailed descriptions coupled with photographic images. All images are a general representation of the item and any sizes and weights given are an approximation. Slight variations may occur like colours and packaging in the actual goods.
 
 
5.CONSUMER RIGHTS
5.1 If you are contracting as a consumer you may cancel a contract at any time within thirty working days beginning on the day after you received the Product(s) (the "Thirty-Day Cooling-Off Period"). In this case you will receive a full refund on the price paid for the Product(s) in accordance with our refunds policy ( set out below)
5.2 To cancel a contract you must inform us by email or in writing. We would greatly appreciate a brief explanation as to the reason for the return. We will email you with the relevant return instructions. Upon receipt of those instructions you must return the Product(s) to us immediately in the same condition in which you received them with the original packaging slip or alternatively an accompanying letter stating your full address and order number at your own cost. We recommend that you use Recorded Delivery or some other form of trackable delivery when returning the Product(s)
5.3 You have a legal obligation to take reasonable care of the Product(s) while they are in your possession. If you fail to comply with this obligation we may have a right of action against you for compensation
5.4 This provision does not affect your statutory rights
 
6.OUR REFUNDS POLICY
6.1 When you return a Product to us follow the procedure set out in paragraph 4.2 above
6.2 Because you have cancelled the contract between us within the Thirty-Day Cooling-Off Period (paragraph 4.1 above) upon receipt of the returned item we will process the refund due to you as soon as possible and in any case within 30 days of the day you have given notice of your cancellation provided we have received the Product(s) in the condition described in paragraph 4.2 above. In this case we will refund the price of the Product(s) in full including the cost of sending the item to you. However you will be responsible for the cost of returning the Product(s) to us
6.3 Because you claim that the Product is damaged or defective upon receipt of the returned item we will examine the returned Product and will notify you of your refund via email within a reasonable period of time. We will usually process the refund due to you as soon as possible and in any case within 30 days of the day we confirmed to you via email that you were entitled to a refund for the damaged or defective Product. Products returned by you because of damage or a defect will be refunded in full including a refund of the delivery charges for sending the item to you. Please note that we will check all items returned as damaged or defective. In the event we find no fault we reserve the right to re-charge you for the Product(s) and to recover our fees and expenses from you
6.4 We will usually refund any money received from you using the same method originally used by you to pay for your purchase
 
7.UK SHIPPING AND AVAILABILITY
7.1 Free Postage & Packing: Delivery usually 3-5 working days from date of dispatch via Royal Mail. Saturday and Sunday are not delivery days
7.2 1st Class Postage & Packing: Delivery usually next working day but can be 1-2 days from date of dispatch via Royal Mail or Courier. Saturday and Sunday are not delivery days
7.3 We endeavor to dispatch your order on the day of receipt of the same provided your order is received before 14:00. If your order is received after this time or over the weekend or on a bank or public holiday then it will be dispatched on the next business day. During periods of excessive demand or under other exceptional circumstances these indications may increase
7.4 Delivery times notified by the Seller are an estimate only and the Seller shall not be liable for the consequences of any delay in fulfilling the Buyers order.
7.5 In the unlikely event of an item forming part of your order being out of stock we will inform you of this by email and provide you with an indication of when we may expect that item to arrive back in stock. You will be given the opportunity to cancel that part of the order if you so wish. For the avoidance of doubt you shall not be charged for that part of the order until it is dispatched.
7.6 Where the carrier fails to make a delivery to you either because you were not available at the address provided when the carrier attempted to deliver your order and did not collect the order within the time limit set by the carrier or because the address provided is incorrect or does not exist and as a result your order is returned to us we will make a charge not exceeding £5 to cover the costs that we incur in sending your order and paying for its return. Upon receiving your returned order we will issue you with a refund for the amount remaining after the deduction of the aforementioned charges. We regret we cannot be held responsible if the carrier has failed to notify you of an attempted delivery. Please contact the carrier directly.
7.7 In the unlikely event of your order not arriving please note that Royal Mail will not consider it lost until 21 days from the date of dispatch has passed and we cannot resend the missing order until after this time
7.8 European Postage – All items will be sent via Royal Mail International Tracked & Signed Service (which provides tracking and requires a signature on delivery) if the country does not accept this service it will be sent via Royal Mail Signed (which requires a signature on delivery) or Royal Mail Tracked (which provides tracking and scan on delivery). Delivery costs vary depending on weight, an estimation can be obtained from the link in the Shopping Cart. Delivery is normally within 5 to 10 days.
7.9 USA and Rest of World - All items will be sent via Royal Mail International Tracked & Signed Service (which provides tracking and requires a signature on delivery) if the country does not accept this service it will be sent via Royal Mail Signed (which requires a signature on delivery) or Royal Mail Tracked (which provides tracking and scan on delivery). Delivery costs vary depending on weight, an estimation can be obtained from the link in the Shopping Cart. Delivery is normally within 7 to 10 days.
 
8.CONTRACT
8.1 The headings of this agreement are for ease of reference only and shall not affect its interpretation or construction
8.2 The Customer agrees not to assign any of its rights herein without the prior written consent of UK GIFTS AND CARDS
8.3 In the event of any of these terms and conditions or any part of them being judged illegal or unenforceable for any reason the continuation in full force and effect of the remainder of them shall not be prejudiced
8.4 These terms and conditions shall be governed by and constructed in accordance with English Law
