Your terms and conditions of use
These terms apply to items ordered by Internet for Made to Measure furniture. Internet offers relate to Internet transactions only and may not be available in store. Likewise, temporary or local special offers in store do not apply to Internet prices unless expressly specified.
1. Seller
The Seller is Bismah Enterprise Ltd. Registered with Companies House of England & Wales, Registered No:06694868. Register office: Unite 54 Argal Avenue Cromwell industrial state Leyton, London, E10 7QE.
2. Order process
2.1 Our display of products on our website is an invitation to treat and not an offer to sell those goods to you.
2.2 An offer is made when you place the order for your products. Please see Customer Services - How to Use This Website for information on how to place an order (this includes a Frequently Asked Questions section) and as you go through the order process there is also a series of instructions. However we will not have made a contract with you unless and until we accept your offer. (See point 2.5 below)
2.3 We take payment from your card, when we process your order and have checked your card details. Goods are subject to availability. If we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the goods.
2.4 If you enter a correct e-mail address we will send you an order acknowledgement e-mail and order update e-mail(s). These are not order confirmation or order acceptance from us. Should you wish to amend your furniture order you must contact us within 48hours to advise us of the change.
2.5 Unless we have notified you that we do not accept your order or you have cancelled it, order acceptance and the creation of the contract between you and us will take place at the point you are notified that the goods you have ordered are ready for delivery to the address you have given us (see 4.1 below). It does not take place until that stage, even though we may have debited your card (see 2.3 above) or we have sent acknowledging e-mails (see 2.4 above)
2.6 The contract will be formed at the place of despatch of the goods.
2.7 All orders that you place on this website will be subject to acceptance in accordance with clause 2.5 of these terms and conditions.
2.8 We do not file details of your order for you to access and so please print out these terms and conditions and the order acknowledgement for your own records. If you require any information about orders you have placed with us please email us at orders@bismahfurn.co.uk
3. Payment
3.1 Payment may be made by any of the methods indicated on our website.
3.2 You will be charged the current price for buying goods from our website at the date you place your order. All prices are displayed on our website and are inclusive of VAT, where applicable, at 17.5%. We reserve the right to amend prices if there is a change in the rate of VAT. We do our best to make sure that prices are correctly shown but very occasionally an error may occur. If this should happen, we will correct the price and ask you to confirm whether you still wish to purchase the goods at the correct price. If we are unable to contact you we will treat the order as cancelled. We will not accept an order if there is a pricing error.
4. Delivery
4.1 The carrier will contact you to notify that your goods are available and to confirm a date for delivery to the address specified. You are required to take delivery within 14 days of this notification on one of the dates which will be offered by the carrier, otherwise you will be charged an additional fee of £25.00 per week to cover storage costs starting from 14 days after first notification that your goods were available until delivery is made. This payment will be due before delivery.
4.2 Deliveries are normally booked at least 7 days in advance; if you need to change a delivery booking for whatever reason then this must be done with at least 48hours notice or else a £25 charge will be incurred to cover the cost of the cancellation. Bedframe and Headboard orders are delivered via express courier so only 48hours notice will be given.
4.3 You are responsible for checking the condition of the items delivered and must highlight any issues upon receipt with the carrier. The agent will direct all queries at this stage to the manufacturer who will agree a means of resolving the issues that are presented at this time.
4.4 The delivery service provided for Bedroom cabinet furniture is to room of choice, goods unpacked and packaging taken away and goods assembled for Divan Beds and Mattresses the service is delivery to room of choice but not unpacking or assembling, and for Bedframes and Headboards the service is delivery into the property only. The signature of the person accepting delivery at the delivery address will be proof that you or the person, to whom the order is addressed, has received delivery.
4.5 Your order will be constructed to the highest possible standards and should give you years of use if cared for correctly. Please ensure that you read and adhere to care instructions provided by the manufacturer at the time of delivery. 4.6 Please note furniture is available for delivery to UK mainland only.
5. General
5.1 It is your responsibility to ensure that the goods ordered can be delivered, and will fit in to the property and any entranceways/hallways/ corridors etc are wide enough for the goods to pass through, and also will fit in the required location within the delivery premises.
5.2 All measurements are approximate.
5.3 The reproduction of colours is as accurate as the photographic and production process will allow.
5.4 All matters concerning and incidental to any offer or agreement for the purchase and sale of goods from our website shall be in English and construed and governed according to English law and the English courts shall have jurisdiction in all such matters.
5.5 The reductions shown in clearance sections are reductions from the original price charged on the website. Occasionally these prices may have applied more than six months ago. Please email Customer Services should you require further information by accessing Contact Us followed by Email Us.
6. Cancellation
6.1 Under the Consumer Protection (Distance Selling Regulations) 2000 which apply to Internet orders you have the right to cancel your order and receive a refund up to 7 working days after receipt of the goods. (subject to our right to retain an additional charge for services under 1.4.1 or 1.4.2 above). The goods must be kept in reasonable condition and made available for collection. A £75.00 charge will be made for the cost of collection.
