General Terms and Conditions of Viking Direct for sales via eBay.
 
1. Scope of application
The following general terms and conditions apply to all business transactions of Viking with our customers conducted via eBay, and apply to the exclusion of your own terms and conditions. Viking is a trading name of Office Depot International (UK) Limited, a company registered in England and Wales, with company number 2472621. Our postal address and registered office is at 501 Beaumont Leys Lane, Leicester, Leicestershire LE4 2BN.
 
2. Area of delivery
Sales and shipping take place exclusively within the United Kingdom.
 
3. Subject matter of the contract
The sale of goods by Office Depot International (UK) Limited (t/a Viking Direct) to the buyer on the eBay sales platform, in particular the sale of office supplies. Please refer to the individual item descriptions for the essential features of the goods we offer. These goods are offered by us either via our eBay shop as shop items or as general auction items in accordance with the following conditions.
 
4. Conclusion of the contract
 
4.1. Binding offer
The offers of goods placed by the Customer on the general eBay websites or in the eBay shop are binding offers to conclude a contract for the respective item.
 
4.2. Auction
We will determine a starting price and a period (offer period) within which the offer can be accepted by bid. The Customer accepts the offer by submitting a bid via the bidding function. The bid expires if another bidder submits a higher bid during the bidding period. At the end of the auction or in the event of early termination of the offer on our part, a contract for the purchase of the item shall be concluded between us and the highest bidder, unless we are entitled to withdraw the offer and cancel the bids at hand. No contract is concluded after a justified bid withdrawal. Further information on the conclusion of the contract can be found in eBay's terms and conditions.
 
4.3. Minimum price
We may set a minimum price for an auction that differs from the starting price under certain circumstances. In this case, a contract is not concluded if the bid of the highest bidder does not reach the minimum price at the end of the auction.
 
4.4 Auction option Buy It Now (fixed price)
We may also offer products for sale with a Buy It Now (fixed price) option. A contract will be concluded irrespective of the expiry of the offer period and without holding an auction if a Customer makes use of the Buy It Now price (fixed price) option. This option can be exercised by any Customer as long as no bid has been placed on the item or the bids have not yet reached a minimum price set by us
 
4.5 Offer to losing bidders
If the contract between us and the highest bidder fails, the minimum price has not been reached or we wish to sell further identical items, we may, at our discretion, make an offer to the losing bidders via the eBay system in the Buy It Now format (offer to losing bidders).
 
4.6 Multi-auction
We may hold an auction as a multi-auction, where an item can be offered in any quantity and all items must be of the same type and quality (e.g. size, colour, pattern, make, etc.).
 
4.7 Buy It Now (fixed price item)
A Buy It Now offer is a binding offer from the Customer that it will purchase the item at the stated price. The contract is concluded when a Customer clicks the "Buy It Now" button and confirms the transaction. In certain categories we can add the option "Best Offer" to the offer. Interested parties can make us an offer to purchase the item at a certain price. We can accept, reject or make a counter-proposal to a Best Offer. Price proposals from Customers and counter-proposals from us are binding and remain valid for 48 hours in each case. A contract is concluded when we agree on the price with the Customer, whether by using the "Best Offer" function or at the original Buy It Now price. Upon conclusion of the contract, all price proposals and counter-proposals shall lose their validity. For Buy It Now items, we may specify that immediate payment is required with the offer. The Buyer's entitlement to benefits only arises after successful completion of the payment process.
 
4.8 Payment process
The Customer can click on "PAY NOW" after the purchase. This is where the Customer receives all payment information and can view the delivery address and make any corrections necessary. If several items are bought at auction or purchased to be sent in one shipment, the Customer can click on "PAY NOW" if the order is to be completed definitively. The Customer can find more information on the payment process on eBay’s website.
 
4.9 Correction of input errors:
The Customer can correct information before placing an order using the technical means provided by eBay. The corrections can be made directly on the previous offer or order page in the corresponding input fields. After clicking the "Buy It Now" or "Bid" button, a correction may no longer be possible.. The Customer may be able to correct input errors by cancelling the purchase process and, if necessary, starting the order process again from the beginning. Other options may be available on eBay’s technical pages.
 
4.10 Truthful information
The Customer confirms that all information provided by him/her for the auction or purchase transaction (e.g. name, address, e-mail address, bank details, etc.) is true. Any changes must be communicated immediately.
 
4.11 Contract language
The contract language is English only.
 
5. Prices
All stated prices are gross prices in Great British Pounds and include VAT at the statutory rate. They apply exclusively to contracts concluded via eBay. We will be responsible for all E-Bay selling fees.
Product changes
We reserve the right to make product changes without prior notice provided that any such changes do not prejudice you and are reasonable.
 
6. Shipping costs per order
Shipping costs shall be set out at the time you place the order.
 
7. Payment
We generally require payment before shipping. Payment can be made at your choice by bank transfer or by PayPal. Our account information and bank details will be provided to you as part of the payment process.
 
8. Storage of the contract text
Each offer is stored by eBay in accordance with its retention policies. It is advisable you retain the order data separately for your records.
 
9. Warranty and guarantee conditions
All products will be supplied with the benefit of any manufacturer’s end-user warranties and guarantees which come with the product to the extent that we are permitted to transfer them to you. Your statutory rights are unaffected.
You should inspect the products for quality following delivery and you have 30 days from delivery to reject the products for not complying with the contract. If you do not reject the products within 30 days from delivery, you will be deemed to have accepted them. If you wish to reject the Products, then you should let us know as soon as possible (and in any event within 30 days from delivery), give us reasonable details of the reason, and let us collect and inspect the products. If you have a valid claim, we will collect the products (at our cost) and give you a refund for those products or offer you a replacement. We are not responsible for any issues identified or which arise after 30 days of delivery and any such issues must be addressed directly with the manufacturer under any manufacturer’s end user warranties and guarantees.
 
10. Right of revocation
Cancellation policy (Consumers only)
Where you are a consumer, then you have the right to cancel the contract for any products without giving any reason, under the Consumer Contracts (Information, Cancellation and Additional Payments) Regulations 2013 (the "Cancellation Regulations"), on and subject to the terms detailed below. This right is in addition to your statutory rights for faulty or mis-described products. our cancellation right does not apply to the following products (unless such exceptions are not permitted by the Cancellation Regulations): where our website or catalogue states that the cancellation right does not apply to that product; gift cards; products made to your specifications or personalised for you, such as personalised stationary, labels and forms, and stamps; sealed audio or video recordings and sealed computer software packages, if the seals are broken after delivery; stamps; and products liable to deteriorate or expire rapidly.
You may exercise your right to cancel at any time up to the time stated below (the "cancellation deadline"). The cancellation deadline is 14 days after delivery of the products. If the contract covers multiple products, then the cancellation period runs from the delivery of the last of those products.

10.2 Consequences of revocation
If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us). You will have to pay for any loss in value of the goods if this loss in value is due to your handling the goods in a way that is not necessary for testing the quality, characteristics and functioning of the goods.
 
11. Title retention
The goods remain our property until payment has been made in full.

If requested, you must sign for the delivery before our carrier releases them to you. Signing for delivery is for simple proof or receipt purposes and will not affect any your other statutory rights.
 
11. Warranty and guarantee conditions
All products will be supplied with the benefit of any manufacturer’s end-user warranties and guarantees which come with the product to the extent that we are permitted to transfer them to you. Your statutory rights are unaffected.

We will not be liable to you if we are delayed in performing this Agreement or are not able to perform this Agreement because of a matter which we cannot reasonably control, such as war, terrorism, riot or public demonstration, government acts, industrial action, fire, explosion, flood, adverse weather, pandemics, shortages or anything of a similar nature affecting us, our carriers or suppliers.
