In the following terms and conditions, the words "you" and "your" refer to any person accessing the HISAT on-line store; and the words "we","us" and "our" refer to HISAT, HISAT Ltd, and HISAT.com .
These terms and conditions apply to create a separate contract each time you purchase a product at HISAT.com ("the product"). Please read them carefully; you may wish to print this document for future reference.
All Prices are in Pounds Sterling. VAT is included.
Purchases from HISAT.com are made via a secure electronic transaction server, using the following major credit cards: Visa, MasterCard and Eurocard, and debit cards: Delta and Switch. Payments will be debited before products are dispatched. Other payment methods may be used for details contact us by email.
You will not re-sell, hire, sub-license, assign, copy, modify, merge, distribute, transfer, decompile or reverse engineer the product, except as expressly provided by us in these terms and conditions, or to the extent that the restriction is not permitted under applicable law. You will be responsible for providing a safe, secure and satisfactory operating environment in which to use the product.
All products and services are subject to availability and may be withdrawn at any time. We will inform you if a particular product is unavailable for any reason and you will receive a refund of any money you have paid for the unavailable product as soon as possible, and certainly within 30 days of the day you sent your order to us.
In certain countries you will have the right to withdraw from a purchase contract entered into over the Internet within 7 working days of receiving the goods purchased. If you wish to exercise such a right of withdrawal you must notify us by e-mail to hisat@hisat.com that you wish to return the products purchased, we will raise a return number and send it to you via email, immediately upon receiving this return number you must send the products in their original undamaged packaging to us by first class insured mail or a carrier properly packaged and at your expense. Once we have received the products, we will refund the purchase price of the product to you but not the cost of packaging carriage and insurance as soon as possible, and certainly within 30 days. a restoking charge of not less than £5 and usually 10% will be charged
We regret that we cannot exchange a product once it is used we recommend that until you have decided to keep your purchase you treat the product as borrowed new equipment , and we can't exchange product where a warranty seal has been tampered with or where the product shows obvious signs of having been mis-used. e.g. excessively dirty or screws having been removed we can exchange the product if it was incorrectly supplied by us initially. or where you have changed your mind according to the 7 day rule referred to above but reserve the right to apply a handling charge of not less than 5 GBP per item and usually 10% of the goods value before VAT, this charge will cover administration and restocking charge and subsequent loss by us caused by grading of the returned stock - leading to our selling the item at a lower price than new stock, plus the cost of carriage.
It is your responsibility to ensure that your existing equipment is compatable with product that you buy from us, computer hardware and software meet the system requirements stated for each product. As soon as we have delivered the products to you, you will be responsible for the products, subject to these terms and conditions.
Goods must be sent to Credit Card holders address. Orders may be delayed if delivery address differs from Card Holders.
In the case of non-delivery, please wait for 5 days from the date of your order before contacting us at hisat@hisat.com or by post at the above address, in case delivery has been delayed.
In the unlikely event that a product is defective on delivery or damaged in transit, please contact us at hisat@hisat.com within 48 hours of delivery. If the product is defective or damaged other than as a result of your negligence or willful misconduct, you may arrange for its return to us in accordance with our Returns Policy and we will either:(a) repair or replace the product, or part of it; or (b) refund the purchase price and cost of return postage at your discretion.
If the product is not found to be faulty then these costs will pass back to you and you may be refunded for the product less, not less than 5 GBP usually 10% of the value of the goods + VAT where appropriate
We warrant that the product will, at the time of delivery, correspond to our description of them.
You consent to the storage and processing of your personal data by us in connection with the business of HISAT and to the transmission of this data to our business partners for the purposes of our legitimate interests, including fulfillment of your order, statistical analysis, marketing our products and credit control. If you breach this agreement, your personal data may also be disclosed or transferred to third parties to the extent necessary to assist in recovery procedures.
We accept liability for foreseeable loss or damage arising out of our breach of contract, negligence or willful misconduct. We will not be liable for any loss or damage related to any business of yours, such as lost data, lost profits, business interruption or any other indirect, special or consequential loss or damage caused to that business. However, nothing in this contract shall exclude or limit our liability for death or personal injury caused by our negligence.
Neither you nor us will be liable for any delay or failure to perform our respective obligations under this contract due to circumstances beyond our own reasonable control.
These terms and conditions are governed by and construed in accordance with English and Welsh law, and we both submit to the non-exclusive jurisdiction of the English & Welsh courts.
The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. As part of this directive we are pleased to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us. Customers must return their old item to us within 28 days of purchasing their new item. Recycling reduces the environmental and health risks associated with sending electrical goods to landfill. Under the WEEE Regulations, all new electrical goods should be marked with the crossed-out wheeled bin symbol and be disposed of separately from normal household waste. If any part of these terms and conditions that is not fundamental is found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of these terms and conditions.
