la vendita in questione e' soggetta al D.Lgs n. 50 del 15/01/1992 e dalle successive modifiche apportate dall’art. 5 del Decreto Legislativo n. 185 del 22/05/99 che prevede la possibilità da parte dell'acquirente di esercitare il diritto di recesso.

Il diritto di recesso si applica alle persone fisiche (consumatori) che agiscono per scopi che possono considerarsi estranei alla propria attivita' commerciale.

Sono perciò esclusi dal diritto di recesso, gli acquisti effettuati da rivenditori e da aziende.

Il consumatore ha diritto, entro un termine di 10 giorni dal ricevimento della merce, di esercitare il diritto di recesso. Tale diritto consiste nella facoltà di restituzione del bene acquistato al venditore, e nel conseguente rimborso relativo al prezzo di acquisto, intendendo come tale l’importo netto corrisposto per il bene escluse spese aggiuntive quali imballo, manodopera, trasporto, tasse di contrassegno. Le spese di spedizione saranno a carico del consumatore.
