1. Geltungsbereich
Für alle Bestellungen über unseren eBay-Shop gelten die nachfolgenden AGB.
2. Vertragspartner, Vertragsschluss, Korrekturmöglichkeiten
Der Kaufvertrag kommt zustande mit Martig Marcin Czyż.
Auktionsformat
Wenn wir einen Artikel im Auktions- oder Festpreisformat einstellen, geben wir ein verbindliches Angebot zum Abschluss eines Vertrags über diesen Artikel ab. Dabei bestimmen wir den Start- bzw. Festpreis und die Angebotsdauer, also die Frist, binnen derer das Angebot angenommen werden kann. Legen wir beim Auktionsformat einen Mindestpreis fest, so steht das Angebot unter der aufschiebenden Bedingung, dass der Mindestpreis erreicht wird.
Angebote im Auktionsformat können wir zusätzlich mit einer Sofort-Kaufen-Funktion versehen, die Sie ausüben können, solange noch kein Gebot auf den Artikel abgegeben oder der Mindestpreis noch nicht erreicht wurde.
Bei Auktionen nehmen Sie das Angebot durch Abgabe eines Gebots an. Die Annahme erfolgt unter der aufschiebenden Bedingung, dass Sie nach Ablauf der Angebotsdauer Höchstbietender sind. Ihr Gebot erlischt, wenn ein anderer Käufer während der Angebotsdauer ein höheres Gebot abgibt.
Festpreisformat
Wenn wir Artikel im Festpreisformat einstellen, geben wir ein verbindliches Angebot zum Abschluss eines Vertrags über diesen Artikel ab.
Sie nehmen das Angebot an, indem Sie den Button „Sofort-Kaufen“ anklicken und anschließend bestätigen. Bei Festpreisartikeln, bei denen wir die Option „Sofortige Bezahlung“ ausgewählt haben, nehmen Sie das Angebot an, indem Sie den Button „Sofort-Kaufen“ anklicken und den unmittelbar nachfolgenden Zahlungsvorgang abschließen. Sie können Angebote für mehrere Artikel auch dadurch annehmen, dass Sie die Artikel (sofern verfügbar) in den Warenkorb legen und den unmittelbar anschließenden Zahlungsvorgang abschließen.
Option Preisvorschlag
Wenn in einem unserer Angebote unter dem Sofort-Kaufen-Preis die Schaltfläche „Preisvorschlag senden“ angezeigt wird, können Sie uns einen Preis vorschlagen, zu dem Sie den Artikel kaufen würden. Wir können Ihren Preisvorschlag akzeptieren, ihn ablehnen oder ein Gegenangebot unterbreiten. Wenn Sie uns einen Preisvorschlag unterbreiten, geben Sie ein verbindliches Angebot zum Abschluss eines Vertrags über diesen Artikel zu dem von Ihnen vorgeschlagenen Preis ab. Ihr Preisvorschlag ist 48 Stunden lang oder bis zum Angebotsende gültig, je nachdem, welcher Zeitpunkt zuerst erreicht wird. Nehmen wir ihn an, kommt ein verbindlicher Vertrag zustande. Der Preisvorschlag bezieht sich grundsätzlich nur auf den Preis für den angebotenen Artikel.
Korrekturmöglichkeiten
Sie können Ihre Eingaben vor Abgabe der Bestellung mittels der von eBay im Bestellprozess zur Verfügung gestellten und selbsterklärenden Mittel erkennen und korrigieren. Um eine Transaktion abzubrechen, betätigen Sie die „Zurück“-Schaltfläche Ihres Browsers, um wieder auf die Artikelseite oder zum eBay-Warenkorb zu gelangen. Im Warenkorb können Sie durch Änderung der Stückzahl die Menge der Produkte ändern bzw. durch Klick auf „Entfernen“ den Artikel aus dem Warenkorb löschen. Eingabefehler können auch durch Abbruch des Kaufvorgangs korrigiert werden.
3. Vertragssprache, Vertragstextspeicherung
Die für den Vertragsschluss zur Verfügung stehenden Sprachen sind Deutsch und Englisch.
Wir speichern den Vertragstext auf unseren Systemen, die jedoch für Sie nicht zugänglich sind. Über Ihren eBay-Account haben Sie jedoch unter „Mein eBay“ die Möglichkeit, Ihre letzten Bestellungen einzusehen. Der vollständige Vertragstext ist dort nicht zugänglich.
4. Lieferbedingungen
Wir liefern nur im Versandweg. Eine Selbstabholung der Ware ist leider nicht möglich.
5. Bezahlung
In unserem Shop stehen Ihnen grundsätzlich die folgenden Zahlungsarten zur Verfügung:
PayPal, PayPal Express
Im Bestellprozess werden Sie auf die Webseite des Online-Anbieters PayPal weitergeleitet. Um den Rechnungsbetrag über PayPal bezahlen zu können, müssen Sie dort registriert sein bzw. sich erst registrieren, mit Ihren Zugangsdaten legitimieren und die Zahlungsanweisung an uns bestätigen. Nach Abgabe der Bestellung im Shop fordern wir PayPal zur Einleitung der Zahlungstransaktion auf. Die Zahlungstransaktion wird durch PayPal unmittelbar danach automatisch durchgeführt. Weitere Hinweise erhalten Sie beim Bestellvorgang.
6. Widerrufsrecht
Ihnen steht das gesetzliche Widerrufsrecht, wie in der Widerrufsbelehrung beschrieben, zu.
7. Eigentumsvorbehalt
Die Ware bleibt bis zur vollständigen Bezahlung unser Eigentum.
8. Gewährleistung und Garantien
Es gilt das gesetzliche Mängelhaftungsrecht. Informationen zu gegebenenfalls geltenden zusätzlichen Garantien und deren genaue Bedingungen finden Sie jeweils beim Produkt und auf besonderen Informationsseiten im Online-Shop.
9. Streitbeilegung
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die Sie hier finden. Verbraucher haben die Möglichkeit, diese Plattform für die Beilegung ihrer Streitigkeiten zu nutzen. Zur Beilegung von Streitigkeiten aus einem Vertragsverhältnis mit einem Verbraucher bzw. darüber, ob ein solches Vertragsverhältnis überhaupt besteht, sind wir zur Teilnahme an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle verpflichtet. Zuständig ist die Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. An einem Streitbeilegungsverfahren vor dieser Stelle werden wir teilnehmen.

1. Access data and hosting
You may visit our website without revealing any personal information. With every visit on the website, the web server stores automatically only a so-called server log file which contains e.g. the name of the requested file, your IP address, the date and time of the request, the volume of data transferred and the requesting provider (access data), and documents the request.
These access data are analysed exclusively for the purpose of ensuring the smooth operation of the website and improving our offer. This serves according to Art. 6 (1) 1 lit. f) GDPR the protection of our legitimate interests in the proper presentation of our offer that are overriding in the process of balancing of interests. All access data are deleted no later than seven days after the end of your visit on our website.
2. Data collection and use for processing the contract, making contact
Your personal data that you disclose to us when you place an order with us or contact us (e.g. via contact form or by email) are collected via eBay or directly by us. All data collected via eBay are processed on the servers of eBay and are according to Art. 6 (1) 1 lit. b) GDPR disclosed to us for the purpose of performing the contract or processing your contact request.
Mandatory fields are marked as such because we absolutely need those data to perform the contract or process your contact request, and you would otherwise not be able to complete your purchase order or send the contact request. It is specified in each input form what data are collected. We use the data that you disclose to us to perform the contract and process your enquiries according to Art. 6 (1) 1 lit. b) GDPR. Upon contract completion, any further processing of your data will be restricted, and your data will be deleted upon expiry of any retention period applicable under relevant regulations, unless you expressly agree to the further use of your data or we reserve the right to otherwise use your personal data in the scope and manner permitted by law, of which we inform you in this notice.
3. Transfer of data
We disclose your data to the shipping company in the scope required for the delivery of the ordered goods according to Art. 6 (1) 1 lit. b) GDPR. Depending on the payment service provider you have selected during the ordering process, we disclose the payment details collected for order processing purposes to the bank commissioned to handle the payment and, as the case may be, to the payment service provider commissioned by us or to the selected payment service. Some of those data are collected by the selected payment service providers themselves if you open an account with them. In such a case, during the ordering process, you must register with your payment service provider using your access data. In this respect, the privacy notice of the relevant payment service provider applies.
4. Use of data for payment processing
Credit assessment and scoring in the case of selecting PayPal purchase on invoice
If you select the purchase on invoice option, it is required for the purpose of signing the contract that we transfer personal data, such as the first and last name, address, date of birth and account data to PayPal according to Art. 6 (1) 1 lit. b) GDPR so that they can carry out identity and credit assessment necessary for the processing of the purchase on invoice transaction. Those data are transferred to enable PayPal to issue an invoice using the invoicing method requested by you and carry out identity and credit assessment as part of processing of your purchase. 5. Contact possibilites and your rights
Being the data subject, you have the following rights according to:
• art. 15 GDPR, the right to obtain information about your personal data which we process, within the scope described therein;
•art. 16 GDPR, the right to immediately demand rectification of incorrect or completion of your personal data stored by us;
• art. 17 GDPR, the right to request erasure of your personal data stored with us, unless further processing is required
- to exercise the right of freedom of expression and information;
- for compliance with a legal obligation;
- for reasons of public interest or
- for establishing, exercising or defending legal claims;
• art. 18 GDPR, the right to request restriction of processing of your personal data, insofar as
- the accuracy of the data is contested by you;
- the processing is unlawful, but you refuse their erasure;
- we no longer need the data, but you need it to establish, exercise or defend legal claims, or

Right to object
