How can something be labeled new if the seals have been broken and parts have been removed. Received with broken seals and missing parts

Item was sold new. Description said NO MINIFIGURES were included. How else are the minifigures are supposed to be removed if the seals are not opened? The item was shipped exactly as described. Only minifigure parts were removed. The rest of the set is complete. It doesn't appear that the buyer read the description I put in the auction listing.
