Bought this item as 'New'. Received an obviously used item. Foil is missing. No manual (not sure if this is normal). There's a part of a fingerprint on the CD which is not from me. Description says: "immaculate new condition". This description is false. Considering the negative feedback for this seller, I wonder why ebay does not ban him.

The text in your auction says that the pictures of the game were "honestly photographed". Thus they are your pictures, which clearly show the game you offered lacks the foil and thus is not new.
