DIRITTO DI RECESSO

1) Il consumatore, in conformità al Decreto Legislativo 22 Maggio 1999 n.185 (Attuazione della direttiva 97/7/CE relativa alla protezione dei consumatori in materia di contratti a distanza) ha diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo entro e non oltre il termine di 10 giorni lavorativi dal ricevimento della merce. Il suddetto decreto definisce consumatore "la persona fisica che agisce per scopi non riferibili all'attività professionale eventualmente svolta". Perciò tale diritto esercitabile solo da coloro che acquistano come persone fisiche per scopi personali non riconducibili alla propria attività lavorativa. Restano dunque esclusi da questo diritto tutti coloro che acquistano come persone giuridiche per scopi inerenti ad attività commerciali e/o indicano quindi nell'ordine la partita IVA. Tale diritto non può essere rivendicato neppure per acquisti fatti da rivenditori o da soggetti che a qualsiasi titolo acquistano per la rivendita a terzi.

2) Il diritto di recesso si esercita con l'invio, entro il termine previsto, di una e-mail contenente la descrizione del prodotto acquistato e il nome utente e-Bay dell'acquirente al nostro indirizzo email

3) Dopo aver ricevuto tale comunicazione contatterò il cliente indicandogli le modalità da seguire per la restituzione. Il consumatore dovrà poi restituire il prodotto con spese di spedizione a proprio carico come previsto dal Decreto su indicato (Art.5, comma 6).

4) Assicurarsi di spedire con un sistema che preveda una firma alla ricezione della merce. Infatti nessun rimborso potrà essere eseguito qualora la merce relativa al recesso non arrivasse a destinazione.

5) La merce deve essere rispedita integra e nel suo involucro originale con adeguato imballo esterno, non utilizzata e/o in alcun modo alterata. All'interno del pacco dovranno esserci tutti gli accessori dati in dotazione originariamente. La merce deve pervenire al mittente in condizione di essere rivenduta.

6) Rimborserò al consumatore l'importo da lui pagato (ad esclusione delle spese di spedizione che non sono di nostra competenza) entro 30 giorni dal ricevimento della merce restituita, AVVALENDOSI DI PAYPAL O TRAMITE BONIFICO BANCARIO, secondo le modalità che saranno concordate direttamente con il consumatore (Art.5, comma 7).
