Può esercitare il diritto di recesso (e recedere dal contratto per qualunque motivo) il cliente-consumatore (ossia una persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale).

Per esercitare tale diritto il cliente dovrà inviare a Theluxium una comunicazione entro 30 giorni lavorativi dalla data di consegna della merce unitamente al modulo di autorizzazione che Theluxium avrà provveduto ad inviare al cliente.

Il costo di restituzione è a carico dell'acquirente ed è pari a 5 euro.

Nota Bene: Non possono esercitare il diritto di recesso i clienti che acquistano con Partita IVA.

Il diritto di recesso è comunque sottoposto alle seguenti condizioni:

Il bene acquistato dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (comprese imballo ed eventuale documentazione e dotazione accessoria);

Per limitare danneggiamenti alla confezione originale raccomandiamo, quando possibile, di inserirla in una seconda scatola (è proibita l'applicazione di etichette o nastri adesivi sulla confezione originale del prodotto);

La spedizione, fino all'arrivo nel nostro magazzino, è sotto la completa responsabilità del cliente;

Theluxium non risponde in nessun modo per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate. Non verranno ritirati in nessun caso pacchi in contrassegno né in porto assegnato.

RIMBORSO AL CLIENTE

Fatte salve eventuali spese di ripristino per danni accertati all'imballo originale, Theluxium provvederà a rimborsare al cliente l'intero importo già pagato per il prodotto tramite procedura di storno dell'importo addebitato su conto Pay Pal o a mezzo Bonifico Bancario. In quest'ultimo caso, sarà cura del cliente fornire tempestivamente le proprie coordinate bancarie (Codice IBAN).

QUANDO DECADE IL DIRITTO DI RECESSO

Il diritto di recesso decade nei casi in cui Theluxium accerti:

Utilizzo anche parziale del bene;

La mancanza della confezione esterna e/o dell'imballo interno originale;

L'assenza di elementi integranti del prodotto;

Il danneggiamento del prodotto per cause diverse dal suo trasporto.

Nei casi sopra indicati, Theluxium provvederà a restituire al mittente il bene acquistato, addebitando allo stesso le spese di spedizione.

COMUNICAZIONI E RECLAMI

Tutte le comunicazioni o gli eventuali reclami del Cliente nei confronti di Theluxium relativamente ai Contratti d'Acquisto dovranno essere indirizzate al Servizio Clienti.

FORO COMPETENTE

Il Contratto d'Acquisto tra il Cliente e Theluxium s'intende concluso in Italia e regolato dalla Legge Italiana. Per qualsiasi controversia sarà competente l'Autorità Giudiziaria di Padova.
