These terms and conditions shall be governed by and construed according to English Law. If at any time you wish to ask us regarding our terms and conditions please contact us and we will be happy to help. The following terms and conditions apply to all transactions between the purchaser and CLS Distribution and apply to all sales via Ebay, via our website and via the telephone. Use of our Ebay shop, our website and placing of an order via the telephone indicates your acceptance of these terms and conditions. These terms are subject to change at any time, changes will take effect on the date they are visible on Ebay / our website. Please read them carefully and print a copy for future reference. CLS Distribution will endeavour to ensure the accuracy of all information made available on our Ebay listings and our web site. All goods remain the property of CLS Distribution until paid for in full. By purchasing these goods you are agreeing to these Terms and Conditions. These terms and conditions do not affect your statutory rights. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions. Acceptance of your order and completion of the contract between you and CLS Distribution will take place upon dispatch of the order to you. All accessories supplied with a product are subject to upgrade or change at the manufacturer’s discretion. Pricing and Payment Terms The total price payable for the goods will be stipulated at the time you place your order whether or not the order has been confirmed. Prices may be subject to change in some circumstances. In all cases we will inform you of the correct price and give you the opportunity to cancel your order. Payment for orders can be made via Paypal, Visa, MasterCard, Maestro and Solo. When placing an order with CLS Distribution the billing address and telephone number must be supplied correctly. Where payment is made via debit or credit card the address must match the address the card is registered to. Please note: Where payments is made via ECheque there will be a delay in dispatch until the ECheque has cleared. Special offer prices are available whilst stocks last. CLS Distribution reserves the right to withdraw the special offer at any time. Any prices quoted by CLS Distribution at the time of order but prior to receipt of payment will be held for a period of 30 days unless otherwise stipulated at the time of quotation. Discount codes used against purchases from CLS Distribution will be subject to our terms and conditions. Only one code can be used for any one purchase and codes cannot be exchanged for any monetary value. Availability of Goods All items are subject to availability at the time of placing your order and may be withdrawn at any time. In the event that CLS Distribution is unable to fulfil your order we will inform you via telephone or email (in the event of a contact number not being available). We will endeavour to propose a suitable alternative, should this not meet your requirements an immediate refund will be made. Ordering CLS Distribution does not accept orders from outside the UK. On placing an order through Ebay or our website it is the purchasers’ responsibility to ensure a clear and correct delivery address is provided including the recipients name. Should you wish your purchase be delivered to a different address an email should be sent immediately after placing your order. Please note the delivery address must fall within our delivery terms below. Delivery Terms and Conditions Delivery charges are stated within our delivery rates area and will be clearly stated and added to the price of the products at checkout. Delivery prices quoted are for all UK addresses, excluding the Channel Islands and Scottish Isles. AM and Saturday deliveries are optional and will incur additional charges, please contact us for details. Most stock items are dispatched for delivery within 3 working days from clearance of payment. We will endeavour to deliver goods within the times stated. On occasion goods are subject to availability and delay in delivery of goods is sometimes outside our control. CLS Distribution will not be held liable for any delay in delivery caused by courier issues/disputes or severe weather conditions. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. As soon as an CLS Distribution designated courier has delivered the goods to your door you will be responsible for them. We will only deliver goods to the address on the order unless otherwise agreed and goods will not be left without a signature. From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk. Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery and will be fully investigated. If goods arrive in a damaged condition you must make a note on the carrier s delivery consignment note and it will be your responsibility to inform us within 7 working days from delivery. It is your responsibility to sign for the correct number of packages as shown on the carrier s delivery consignment note. Any shortages must be noted on the consignment note and it will be your responsibility to notify us within 7 days from delivery. If we supplied you with a product other than ordered it is your responsibility to notify us of any incorrect goods supplied within 7 working days from delivery. CLS Distribution will not accept liability for goods that have been lost in transit unless we are notified within 7 days from the expected delivery date. UK Post codes outside of Normal Delivery Rates If the first part of your postcode is listed below please call us as you will be charged at cost for postage. The cost of postage will be dependent upon weight, the dimensions of the parcel, the value of the contents and destination. Please note that it is our carriers who decide which areas are classed as Highlands or Islands and not us. Also the list below is subject to change. This guarantee specifically excludes installation of electrical fittings by a non qualified electrician, faults caused by accident, neglect, and misuse. In addition routine maintenance (cleaning etc.), consumables (light bulbs, plug fuses, cables etc.) and cosmetic damage are not covered. Your statutory rights are NOT affected in any way by our terms. RETURNING AN ITEM: Items must always be returned as supplied with original packaging in all cases. All items returned will be inspected to ensure they have been returned in satisfactory condition prior to any refund being made. Where this is not the case CLS Distribution will contact the purchaser with details. CANCELLED ORDERS No postage refund applies. Item(s) must be returned within 14 days of delivery. Under the current Distance and Selling Regulations (2000) you have the legal right to cancel your order within 14 days of receipt of your goods. Where an item is to be returned for refund due to no fault of our own, within the 14 day (from date of delivery) time frame, then the customer must meet all return transport costs. Item(s) must be returned in the original packaging using only clear tape on the manufacturers box. The returnee must take care to ensure the goods are packed securely and clearly marked on the external packaging (not the manufacturers box)with the return address and the returnee’s name and address. We recommend that the delivery is insured for the full value of the goods as in the event that the items are received in a damaged condition, no refund will be made and any warranty supplied by ourselves will become void. You should also ensure that you use an insured carrier to deliver the goods unless CLS Distribution has agreed an alternative. The carrier must also obtain a signature for any deliveries as no claim can be made against CLS Distribution for missing items without specific proof of receipt of goods. FAULTY GOODS Post refund applies to a maximum of £5.99 unless prior agreement has been obtained from CLS Distribution . All non consumable goods supplied by CLS Distribution are supplied with a full 12 month warranty. As such a replacement will be issued upon receipt of the damaged item(s). The major exceptions to this rule are glass shades/covers and consumables such as light bulbs and fuses etc. Where a glass shades/cover is broken on receipt this must be reported within 48 hours. CLS Distribution will then do their utmost to send a replacement immediately. Please read below carefully: Postal refunds will only be made on prior approval and provision of a valid receipt or if returned via royal mail where a label stating the return cost is present. Please note: proof of posting is NOT a receipt. REFUNDS All refunds will be made no later than 7 days after the first notification of the cancellation of the order or for returned goods within 7 days of receipt of the returned items providing all terms have been met. WARRANTY TERMS All non consumable items supplied by ourselves include a 12-month return to base warranty providing that the following terms are met:- 1. The item is only used in the manner it is designed to be used. 2.No signs of misuse are present. 3.All requirements for use detailed in any literature supplied are complied with. 4.By UK law, all lighting products that require wiring to a mains electricity supply must be done by a fully qualified and certified electrician. Any damage to the product incurred by lack of qualified installation will void the warranty of the product. Please note glass shades/covers and consumables such as light bulbs and fuses etc are not covered by the 12 warranty. Confidentiality and Security CLS Distribution will make every effort to ensure that any personal information held by CLS Distribution is kept secure and destroyed once your order is complete. CLS Distribution takes great care to ensure our website is free of any viruses and can not be held responsible for the users computer or use of the website. We will not be liable for any loss or damage which could arise or the capture of personal information by third parties.
