Please read the terms in full before you make any bids. If you do not accept these terms, please do not bid on any items. Bidding on any of Budget Motor Spares ebay item implies that you accept these terms. These Terms and Conditions of Sale apply to all transactions for the sale of goods on the Budget Motor Spares ebay store.
Please read them carefully. They do not affect your statutory rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the ebay.
1.THE SHOP
1.1 The Budget Motor Spares ebay store is a registered ebay business seller. All of the goods on this ebay shop are offered by Budget Motor Spares ("we/us") will be the contracting party for any order that you place.
2.THE CONTRACT
2.1 Acceptance of your order and the completion of the contract between Budget Motor Spares ebay store (supplier) and you, (the customer), will take place when the goods have been paid for by you and despatched by us. Any email, order confirmation or other electronic acknowledgement by us of receipt of an order does not constitute legal acceptance by Budget Motor Spares ebay shop of your order.
2.2 In the event that there are any errors regarding price or description, we reserve the right to notify you as soon as possible and give you the options to proceed with this revised order at the correct price/description, or to cancel the order. In these circumstances, upon cancellation, your payment will be refunded in full if not being posted. In case the item has been posted than the postage price will not be refunded.
2.3 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your paypal account for the goods.
3.ORDERING
3.1 Please read product description carefully before you make any bidding. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the "confirm order" button on the check out page.
3.2 All orders made by you through the mylitco ebay shop are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.
3.3 Budget Motor Spares ebay shop will confirm receipt of your order by sending an email to you, using the address you supplied when registering with ebay. This email is only an acknowledgement and does not constitute legal acceptance by us of your order.
3.4 Any email or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order. Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the goods you have ordered have been despatched to you unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation and returns policy.
4.PAYMENT
4.1 We accept payment by Paypal. We can only deliver the goods to Paypal registered address. If you are paying by e-cheques via Paypal, your goods will not be despatched until the payment is cleared. We reserve the right to cancel any e-cheque payment at any time if the certain goods are out of stock.
4.5 We DONOT accept personal or business cheque and postal order payments in accordance with payment methods section.
4.6 To prevent online payment fraud, in certain circumstances, we reserve the right to carry out additional checks before despatching goods.
5.REFUNDS
(FULL REFUNDS MINUS 20 PENCE WILL BE ISSUED TO BUYERS USING 1ST CLASS OR RECORDED POSTAL SERVICE, RETURN OF GOODS TO CLAIM REFUND WILL BE BUYER'S RESPONSIBILITY)
5.1 If we acknowledge an order but, for some reason outside our control, we are unable to complete the transaction within 28 days then any payment made will be refunded immediately if you ask us to do so. Refunds due against returned goods will be paid as soon as the returned goods are received by us, subject to the goods being received in unused, undamaged condition in their original, unsoiled undamaged packaging.
5.2 We will refund you using the same payment methods you made the payment. For example, if you paid the goods via paypal, we will refund your money back through paypal.
5.3 You will be entitled for full refund if item has not been dispatched. If the item has been dispatched and you need refund than for refund you need to return the item back to us before the refund being issued. Postage + 20 Pence will not be refunded in this case.
5.4 You will receive item refund only in case of item not received by you but has been dispatched by us. Postal Charges + 20 Pence will not be refunded.
5.5 All return refunds will be issued once the returned item will be received by us.
6.PRICING
6.1 We endeavour to ensure that all published prices are correct, however we reserve the right to change prices without notice and not to accept orders at prices that have been quoted in error. Prices are quoted in pounds sterling and unless specifically stated.
7.PACKING & POSTAGE
7.1 Postage charges mentioned or printed on the pack for each item is not only for postage/ Royal Mail/ Courier used. It includes estimated packing material, printing material, rental of postal equipment, time and labour spent and other miscellaneous charges like paypal, estore, etc., occurred on an item dispatch to you. This may vary any time without prior notice.
7.2 No claim / complaint will be entertained or answered in such regards after buying of any item because the buyer agreed for all charges are the time of bidding and purchasing the listed item.
7.3 Moreover, it is the Buyers' responsibility to make sure before bidding / purchasing any item listed.
7.4 For refunds in regards to the postal charges please read our REFUND section before applying for any refund.
8.RIGHT TO WITHDRAW GOODS
8.1 We reserve the right to withdraw any goods from the ebay at any time.
8.2 We will not be liable to you or anyone else for withdrawing any goods from the ebay.
9.DISPATCH & DELIVERY
9.1 We aim to despatch orders same working day to maximum within 24 hours of receipt, subject to stock availability, but please allow up to a maximum of 14 days for delivery. Orders are delivered by the most appropriate method, usually first class post, parcel post or courier. If any delays occur, we will endeavour to keep you informed. If dispatch is delayed beyond 28 days, we will always give you the option of receiving a full refund of any payments that you have made.
9.2 Orders will be sent to the delivery address that you have registered with ebay. We cannot be held responsible if this delivery address is incorrect. If you wish to change the delivery address prior to submitting your order you may do so by editing your ebay postal address. If you wish to change your delivery address and an order is "IN PROGRESS" you must contact the Customer Services team 020 3006 3081.
9.3 Once the goods have been received by you, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.

10.CANCELLATION AND RETURN
10.1 The return / refund of any Electrical / Electronic item will not be accepted.
10.2 If you are a domestic consumer and you are unhappy with the goods for any reason, you have the right to cancel your order with us within 7 days of the date of delivery. Provided that it is returned to us in its original and unused condition (including in its original packaging), along with the wrapping and delivery note (as proof of purchase).
10.3 Please do not return any items to Budget Motor Spares without first contacting us by email, fax or filling in our enquiries form to ask for a returns authorization number (RAN). We can not issue a RAN by phone.
10.4 Any delivery charge/ Postage / Courier Charges paid for the delivery of the goods will not be refunded in the event of cancellation made by customer.
10.5 Goods can only be returned for a refund or exchange if they are in the same original unopened condition as when they were despatched, therefore we strongly advise all customers to ensure they have the correct product for their requirements before opening the packaging, please do not stick tape or repackage any items as we will be unable to resell and therefore you will forfeit your refund.
10.6 Returned goods remain the responsibility of the customer until they have been signed for by a Budget ebay shop member of staff. We therefore strongly recommend that any returned goods are returned in an adequately padded packaging. We only accept returns sent by traceable signature prove delivery methods, such as royal mail recorded delivery.
10.7 Returns will only be accepted with our prior agreement as detailed in our returns policy. Please refer to the website delivery and return section for the full details of our returns policy.
11.SPECIFICATIONS AND INFORMATION
11.1 Goods are supplied subject to the company's standard specifications and, unless specifically agreed to the contrary, may be manufactured by any of our approved vendors. While we endeavour to publish and supply as much product and application data as possible, the company is unable to assess the viability of every possible application of the goods: It is the customer’s duty to ensure that the goods ordered are suitable for the application in which they intend to use them. We endeavour to ensure that all published information is correct but the company shall not be under any liability for any direct, indirect or consequential damage, loss or expense that may be caused as a result of any error or omission in any information either published by or supplied by the company. Please note that exact colours and finishes are difficult to reproduce accurately on website and printed materials and customers should not place undue reliance upon such reproductions.
12.DISCLAIMER
12.1 Car modifications are carried out at the owners risk, some items are for show purposes only and may or may not be street legal, please check before purchasing as we will accept no responsibility for any trouble you may encounter with the appropriate authorities.
12.2 LED bulbs and HID conversion kits are not strictly road legal as they cannot be E-marked, this does not apply if your vehicle has LEDs or HID's fitted as standard. Higher wattage bulbs are also not road legal. We therefore sell LED bulbs, HID kits and high wattage bulbs for off-road use only.
13.COMPLAINT
13.1 We aim to deal with any complaints in a fair and timely manner. Any complaints should be addressed in writing to the company at the published address or via ebay.
14.LAW
14.1 The laws of England shall govern these Terms and Conditions of Sale and you agree to submit to the non-exclusive jurisdiction of the English courts. We are required by law to inform you that sales can be concluded in English only and that no public filing requirements apply.
