Withdrawal from the sales contract by the customer

1. A Customer who is a consumer can withdraw from the sales contract within 14 days with no need for reasons to be explained. The deadline shall run from the date of conclusion of the contract and whenever it is the Seller’s duty to deliver the goods – from the date of collecting them by the Customer.

2. The Customer cannot withdraw from the remote sales contract:

a. concluded for Goods manufactured according to the Customer’s specification or those which meet their customized expectations,

b. concluded for Goods delivered in sealed packages, which having been opened after delivery.

3. The statement of withdrawal from the contract can be developed according to withdrawal form.

4. To meet the deadline for withdrawal from the sales contract, all that the Customer has to do is to send the statement to the Seller’s address or e-mail: biuro@vest-pol.pl, before the expiry of the deadline referred to in item 1.

5. Should the Customer who is a Consumer withdraw from the sales Contract, the Goods should be returned along with the statement of withdrawal from the Contract or immediately after that statement, no later, however, than within 14 days after their withdrawal from the contract.

6. As soon as they have received a compliant statement from the Customer who is also a Consumer, not later, however, than within 14 days, the Seller shall return to the Customer the price of the Goods (including delivery) provided that it has already been paid.

7. The Goods shall be returned at the Customer’s expense. The Seller can refuse to collect the Goods returned at their expense.

Rücktritt vom Kaufvertrag des Kunden, der zugleich Verbraucher ist

1. Der Kunde, der Verbraucher ist, kann von dem Kaufvertrag innerhalb von 14 Tagen ohne Begründung zurücktreten. Der Termin beginnt seinen Lauf ab dem Datum des Vertragsabschlusses, und wenn auf dem Verkäufer die Pflicht der Lieferung der Sache lastet – ab dem Datum der Inbesitznahme der Sache durch den Kunden.

2. Der Rücktritt vom Fernabsatzvertrag steht dem Kunden in Bezug auf einen Vertrag nicht zu:

a. in dem die Ware eine gemäß der Spezifikation des Kunden hergestellte oder der Befriedigung seiner individuellen Bedürfnisse dienende Sache darstellt,

b. in dem die Ware in einer versiegelten Verpackung geliefert wird, sofern die Verpackung nach der Lieferung geöffnet wurde.

4. Zur Wahrung der Frist für den Rücktritt vom Kaufvertrag genügt die Versendung durch den Kunden der Erklärung an die Anschrift des Verkäufers oder mittels elektronischer Post: biuro@vest-pol.pl, vor Ablauf der in Abs. 1 genannten Frist.

5. Beim Rücktritt von dem Kaufvertrag durch einen Kunden, der Verbraucher ist, sollte die Rücksendung der Ware mit der Erklärung über den Rücktritt vom Kaufvertrag durch den Kunden oder unverzüglich nach dieser Erklärung, jedoch spätestens innerhalb von 14 Tagen ab dem Rücktritt vom Vertrag erfolgen.

6. Unverzüglich nach Erhalt der wirksamen Erklärung des Kunden, der zugleich Verbraucher ist, über den Rücktritt vom Vertrag, jedoch spätestens innerhalb von 14 Tagen, ist der Verkäufer verpflichtet, dem Kunden den Warenpreis (einschließlich Lieferung) zu erstatten, sofern er früher gezahlt wurde.

7. Die Rücksendung der Ware erfolgt auf Kosten des Kunden. Der Verkäufer kann die Abnahme der Ware auf Kosten des Verkäufers verweigern.
