1.1. These T&C's refer to Fixed Asset Disposal Ltd trading as eBay user ID fixedasset-sales
1.2. These Conditions shall supersede all earlier conditions of fixedasset-sales weather written or verbal
1.3. These conditions shall take precedence over any conditions of the customer and shall not be varied without the written consent of a partner of fixedasset-sales.
2. Prices and Ordering
2.1. Overseas and Non EU orders will be subject to local taxation for which we have no control and will not be held liable for.
2.2. The price payable by the customer will be the price current at the date of the order.
2.3. Reservation of products does not constitute an order and is not binding on either party.
2.4. fixedasset-sales reserves the right to cancel or refuse any order without written consent or notification.
2.5 fixedasset-sales reserves the right to amend/change orders that equals or betters the configuration to equipment that fixedasset-sales has issues sourcing induvitial items i.e item sold with 12TB storage - 3 x 3TB HDD amended to 6 x 2TB due to stock issues or failed items
3.1. We accept payment via the following methods i) Paypal ii) Cash on Collection iii) Direct Bank Transfer BACS CHAPS
3.2. Payment/contact must be made within 1 working days of the end of auction/sale
3.3. Payment must be cleared before goods will be dispatched.
3.4. Failure to collect paid goods after 1 working week will result in a daily charge of £15.00 payable before goods are released; this is at the management’s discretion.
4.1. Products supplied fixedasset-sales are delivered at the risk of fixedasset-sales unless otherwise stated in the listing. If a parcel is delivered damaged then it must be signed for as 'Damaged'. Customers must inspect the goods immediately following delivery and contact fixedasset-sales within 24 hours to notify of any; damage caused in transit; missing or lost items. Your statutory rights are not affected.
4.2. Goods will be shipped in most cases within 3-4 working days of receipt of cleared funds. Should there be a delay in processing your order you will be notified immediately and details of expected delivery will be made available
4.3. Advertised prices only include shipping to Mainland UK. Carriage costs to Northern Ireland / Highlands & Islands / Isle of Man / Channel Islands / Isle of Wight may be higher. NON Mainland locations are defined by our shipping agent and NOT personal preference.
4.4. Goods delivered to a shipping hub, forwarding freight company, space storage location and or company/person which requires onward shipping to final location not booked by fixedasset-sales is NOT covered by ANY WARRANTY or RETURNS
4.5. Shipping cost is for 2 attempted deliveries, if you’re not available for delivery please inform the shipping agent when a Not Available or Redelivery Booking card is left * by the number on the card or with our shipping agent to re arrange delivery. Failure to do so will result in your item being marked as a failed delivery and reshipped back to fixedasset-sales which there is a standard cost of £16 + Vat. If you then require your goods to be reshipped the £16 + Vat return cost plus the original delivery cost will need to be paid for by the “customer” before goods can be redelivered. * if applicable Address’s with Access Control or Gated Residence will need to arrange for delivery's direct with the booked shipping agent.
4.6. Goods to be delivered Palletized, Heavy or Large items are Door to Door ONLY, the "buyer" will need to arrange for the goods to be moved from the delivery point which is defined as but NOT limited to Front Door/Entrance of building and or safe location for delivery ONLY; to the final location, upper floors, basement, additional site or location; this is NOT the responsibility of the delivery driver and or representative of fixedasset-sales due to Health & Safety and insurance liability/constraints. Please be aware of this when ordering heavy/bulky/large palletized items.
4.7. ANY Refused delivery for ANY reason will not be covered for outbound or return shipping costs, additionally a 25% restocking fee will apply to refused delivery's which is deducted from the final return costs.
5.1. All items sold on a "Buy It Now" Format are supplied with 30 day return to base warranty - unless otherwise stated in the eBay returns policy.
5.2. The Customer should return the product in its "original packaging" to fixedasset-sales. Prior authorization must be obtained for any returns by contacting FixedAsset-Sales and obtaining written authorization to return, do not use the eBay Returns process.
5.3. Unless otherwise stated, all items sold on a "Buy It Now" Format come with a 30 day 'Return To Base' warranty. Should your unit fail and require repair within 7 days of receipt, please contact us and we will authorize a return where fixedasset-sales are responsible for carriage costs both ways unless goods were collected by your own shipping agent or in person. Your goods will be repaired, replaced or refunded as requested and returned to you. For orders outside the UK mainland, you will be liable for costs above the standard UK mainland rate.
5.4. In the case of a repair/upgrade during the remaining warranty period, the buyer is responsible for carriage both ways on warranty returns.
5.5. If any item is returned which is found not to be faulty by our technicians, then a £25 + VAT testing fee will be applied and must be received before items can be returned or order cancellation refunded.
5.6. Original packaging must be kept should there be any need for returns. We cannot be held responsible for damages to items returned without original packaging; ANY implied warranty will be NULL & VOID in the event of an item being returned damaged due to not being returned in the "original packaging" or returned without reasonably packaging to prevent damage.
5.7. Items significantly not as described – If the item materially differs from the photographs and listing description then we will refund, or exchange in line with the Sale of Goods Act 1982. If we have dealt with your issue in a timely fashion we ask that items are returned promptly. We may ask for a photo to verify the significant difference, at our discretion we may offer a partial refund, collect the item at no expense to the buyer. Definition of a material difference is a clear error in the description, misrepresentation or undisclosed fault which affects the item and makes it unfit for purpose.
5.8. Any proven undisclosed adaptations, modifications, configuration changes or damage made by the ‘buyer’ after the point of sale and while in the ‘buyers’ possession resulting in an item from functioning correctly will result in the ‘buyers’ request for a full refund void in accordance with the Sales of Goods Act 1982 and current distance selling regulations 2000.
5.8.1 Limited liability – Our liability is limited to the amount paid for the item and the shipping only ITEMS SOLD UNDER AUCTION FORMAT
5.8.2 Items sold under Auction Format – Items sold on auction format as spares and repairs are done so with no warranty expressed or implied, and are sold ‘as is’ any comments in the description are to the best of our knowledge and for guidance to only. No returns for items that are sold under auction format as spares or repairs are accepted and are not covered by Distance Selling Regulations please be clear on this when bidding.
5.9. This clause does not affect your statutory rights.
6.1. Goods that are collected by the 'buyers' own courier or shipping agent will not be offered warranty or any return for items that arrive non functioning when sold as functioning or good working condition - NO EXCEPTIONS
6.2 Collection Confirmation - Please get in contact with us, via email or telephone to arrange a suitable time for collection. Please do not turn up without confirmation from ourselves of a collection time & date; as your item may be unavailable or not ready for collection.
6.3 Please ensure if collecting equipment personally you arrived equipped with the appropriate vehicle to remove; van, Luton Van with tail lift etc. Our staff will NOT be held responsible for damaged caused whilst moving or loading equipment into inappropriate vehicles. NO EXCEPTIONS, failure to comply will result in being asked to leave site without your purchase(s) and return with the appropriate equipment/vehicle.
6.4 Our staff will NOT assist customers load large, heavy or bulky items into customers vehicles due to Health & Safety, and insurance liability issues. NO EXCEPTIONS
6.5 Items purchased will need to be collected within 5 days ONLY, any purchased items over 5 days will accrue storage fees charged at £15 + VAT a DAY and paid items will NOT be released until payment has been completed an cleared.
6.6 Disposal of items; after 31 days if the paid goods are NOT removed from our premises fixedasset-sales reserves the right to dispose of items through appropriate methods/channels - the 'buyer' will forfeit any paid monies and may be charged the storage fee's.
