Ai sensi del D.L. 6 settembre 2005 n. 206, il consumatore può recedere dall’acquisto senza indicarne il motivo entro un mese previa richiesta per iscritto.

In caso di sussistenza dei termini per l’esercizio del diritto di recesso il venditore autorizzerà il consumatore alla restituzione della merce.

La merce resa senza autorizzazione del venditore sarà respinta e resa al mittente. Ad autorizzazione ricevuta,il consumatore è tenuto a restituire la merce entro 7 giorni,pena la decadenza dell'esercizio del diritto di recesso.

Condizione essenziale per l’esercizio del diritto di recesso è la restituzione della merce nel rispetto delle seguenti condizioni. La merce dovrà essere perfettamente integra,nuova,mai usata,completa di tutto quanto ricevuto a corredo del bene acquistato,confezionato nell’imballo originale perfettamente integro completo di tutte le sue parti,perfettamente integre anch’esse.

Il mancato rispetto delle condizioni dettate rende inapplicabile l’esercizio del diritto di recesso.

Secondo quanto previsto dall'art 67 comma 3 del D.L. 6 settembre 2005, n. 206:

Le sole spese dovute dal consumatore per l'esercizio del diritto di recesso a norma del presente articolo sono le spese dirette di restituzione del bene al mittente.

Ricevuta la merce, il venditore ne accerterà lo stato e, verificata l'integrità della stessa nel rispetto delle condizioni dettate, provvederà al rimborso dell’importo del solo valore del bene acquistato,escluso spese accessorie quali spese di spedizione, imballaggio, ecc.,appena possibile e,comunque,non oltre trenta giorni dalla data di ricevimento della merce restituita.

In alternativa, il venditore, in accordo con il consumatore potrà sostituire la merce resa con altra equivalente a scelta del consumatore.

Sono esclusi dal decreto legislativo i soggetti non classificabili come consumatori, ivi compreso coloro i quali hanno richiesto fattura invece dello scontrino fiscale.

Oggetto non conforme:

Secondo quanto stabilito dal comma 2 dell'art. 130 del D.L. 6 settembre 2005, n. 206:

In caso di difetto di conformità, il consumatore ha diritto al ripristino, senza spese, della conformità del bene mediante riparazione o sostituzione, a norma dei commi 3, 4, 5 e 6, ovvero ad una riduzione adeguata del prezzo o alla risoluzione del contratto, conformemente ai commi 7, 8 e 9.

In questo caso il consumatore dovrà rispedire a sue spese la merce in oggetto.

Ricevuta la merce, il venditore ne verificherà la non conformità e,verificata l'integrità della stessa nel rispetto delle condizioni dettate,provvederà al rimborso dell’importo totale del valore del bene acquistato, comprese le spese di spedizione per l'andata e il ritorno della merce, appena possibile e, comunque, non oltre trenta giorni dalla data di ricevimento della merce restituita.

Nel caso la non conformità non venisse riscontrata, la merce sarà rispedita al consumatore con l'aggravio delle nuove spese di spedizione.
