Diritto di Recesso

1. Ai sensi dell'art. 64 e segg del D.Lgs. n. 206/2005, se il Cliente è un consumatore (ossia una persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale, ha diritto a recedere dal contratto di acquisto per qualsiasi motivo, senza alcuna penalità e fatto salvo quanto indicato al successivo Per esercitare tale diritto, il Cliente dovrà inviare una e-mail all'indirizzo ebay.scm.2019@gmail.com entro 30 giorni dalla data di acquisto.

2.Ricevuta la e-mail, SCM invierà al Cliente l’indirizzo a cui far pervenire il bene soggetto a esercizio del diritto di recesso che dovrà avvenire entro 10 giorni dall'autorizzazione.

3. Il diritto di recesso è sottoposto alle seguenti inderogabili condizioni:

• il diritto si applica al prodotto acquistato nella sua interezza; non è possibile esercitare recesso solamente su parte del prodotto acquistato (es.: accessori, software allegati, ecc...);

• il diritto non si applica ai prodotti audiovisivi o a software informatici sigillati (compresi quelli allegati a materiale hardware), una volta aperti;

• il bene acquistato dovrà essere integro e restituito nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: manuali, cavi, ecc...); per limitare danneggiamenti alla confezione originale, raccomandiamo, quando possibile, di inserirla in una seconda scatola.

• il bene soggetto a esercizio del diritto di recesso deve essere restituito in normale stato di conservazione, in quanto sia stato custodito ed eventualmente adoperato con l’uso della normale diligenza: non verranno quindi accettati prodotti utilizzati che riportino segni di danneggiamento o di sporcizia e che di conseguenza non possano più ritenersi integri;

• le spese di spedizione relative alla restituzione del bene sono a carico del cliente

• la spedizione, fino all'attestato di avvenuto ricevimento nel nostro magazzino, è sotto la completa responsabilità del cliente;

• in caso di danneggiamento del bene durante il trasporto, SCM darà comunicazione al Cliente dell'accaduto (entro 5 giorni lavorativi dal ricevimento del bene nei propri magazzini), per consentirgli di sporgere tempestivamente denuncia nei confronti del corriere da lui scelto e ottenere il rimborso del valore del bene (se assicurato); in questa eventualità, il prodotto sarà messo a disposizione del Cliente per la sua restituzione, contemporaneamente annullando la richiesta di recesso;

• SCM non risponde in nessun modo per danneggiamenti o furto/smarrimento di beni restituiti con spedizioni non assicurate;

4. Fatte salve eventuali spese di ripristino per danni accertati all'imballo originale, SCM provvederà a rimborsare al cliente l'intero importo già pagato, entro 14 giorni dal rientro della merce, tramite procedura di storno dell'importo addebitato sulla Carta di Credito o a mezzo Paypal

5. Il diritto di recesso decade totalmente, per mancanza della condizione essenziale di integrità del bene (confezione e/o suo contenuto), nei casi in cui SCM accerti:

• la mancanza della confezione esterna e/o dell'imballo interno originale;

• l'assenza di elementi integranti del prodotto (accessori, cavi, manuali, parti, ...) o anomalie al prodotto stesso;

• il danneggiamento del prodotto per cause diverse dal suo trasporto;

• uno stato di sporcizia del prodotto dovuta al suo utilizzo, che ne abbia compromesso l'integrità. Le spese ed i rischi del trasporto per la restituzione sono integralmente a carico del Cliente. La restituzione di prodotti non integri, deteriorati o privi di accessori e dotazioni originali non sarà accettata da SCM e verrà restituita al mittente con aggravio di spese di trasporto.
