Il cliente ha il diritto di recedere dal contratto entro un periodo di 14 giorni naturali (di seguito denominato periodo di recesso) senza indicare il motivo a partire dalla data di acquisizione materiale del Prodotto da parte del cliente o di un terzo designato dal cliente diverso dal trasportatore.

Nel caso in cui il cliente effettui un ordine con due o più prodotti e questi non vengano consegnati nella stessa consegna, il termine inizierà a decorrere dal giorno in cui il cliente o un terzo designato dal cliente diverso dal trasportatore acquisisca il possesso materiale dell'ultimo dei prodotti. Per esercitare il diritto di recesso, il cliente dovrà comunicare a DESGUACES OLIVARES, entro il periodo di recesso, la sua intenzione di recedere dal contratto, compilando e inviando insieme al reso il modello di modulo di recesso che verrà fornito su richiesta all'indirizzo info@desguacesolivares.es.

Inoltre, il cliente potrà comunicare la sua volontà di recedere dal contratto mediante qualsiasi dichiarazione inequivocabile in cui manifesti la sua volontà di recedere, mediante una lettera inviata per posta certificata all'indirizzo seguente, DESGUACES OLIVARES, Carretera Olivares Villanueva, Km 3 (CP 41804) Olivares (Siviglia) tramite fax al numero 955 990 660 o per e-mail a garantias@desguacesolivares.es.

Se il cliente recede dal contratto entro il suddetto periodo di 14 giorni, nei casi di sostanziale non conformità con il prodotto richiesto, gli verrà rimborsato l'importo pagato previa verifica dello stato della merce, compresi i costi di restituzione come previsto nel punto a) dell'articolo 120 del RDL 1/2007. Sarà indispensabile che i prodotti siano perfettamente imballati per effettuare il reso. In caso di danni ai prodotti dovuti a un imballaggio inadeguato, il reso non sarà accettato. Il cliente dovrà conservare la ricevuta di spedizione dell'agenzia di trasporto incaricata del reso fino a quando DESGUACES OLIVARES non confermerà la ricezione della merce e il suo stato.

Il cliente sarà responsabile della diminuzione del valore dei beni risultante da una manipolazione diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni. In ogni caso, la ricevuta d'acquisto degli stessi sarà indispensabile per qualsiasi reso.

Il rimborso avverrà tramite la consegna al cliente di una Carta Reso senza scadenza per l'intero importo del prodotto restituito, che potrà essere utilizzata sia nel negozio fisico che online, purché il cliente abbia restituito la merce prima della scadenza del periodo sopra indicato; in caso contrario, DESGUACES OLIVARES non emetterà la Carta Reso senza scadenza per l'intero importo fino a quando non avrà ricevuto i beni dal cliente. Si considererà rispettato il termine se il cliente effettua il reso dei beni prima che tale termine sia scaduto. La consegna della Carta Reso senza scadenza avverrà, una volta verificato lo stato della merce, entro un massimo di 14 giorni naturali.
