El Cliente tendrá derecho a desistir del contrato durante un periodo de 14 días naturales (en adelante plazo de desistimiento) sin indicar el motivo desde la fecha de la posesión material del Producto por el Cliente o por un tercero designado por el Cliente distinto del transportista.

En el supuesto de que el Cliente realice un pedido con dos o más Productos y éstos no sean entregados en la misma entrega, el plazo empezará a contar el día que el Cliente, o un tercero designado por el Cliente distinto del transportista, adquiera la posesión material del último de los Productos. Para ejercer el derecho de desistimiento, el Cliente, deberá indicar a DESGUACES OLIVARES, dentro del plazo de desistimiento, su intención de desistir del contrato, cumplimentando y enviando junto con su devolución el modelo de formulario de desistimiento que le facilitaremos previa solicitud a la dirección info@desguacesolivares.es.

Asimismo, el Cliente podrá indicar su voluntad de desistir del contrato mediante cualquier tipo de declaración inequívoca en la que manifieste su voluntad de desistir, mediante una carta enviada por correo postal certificado a la siguiente dirección, DESGUACES OLIVARES, Carretera Olivares Villanueva, Km 3 (CP 41804) Olivares (Sevilla) por fax al número 955 990 660 o por correo electrónico garantias@desguacesolivares.es.

Si el Cliente desiste del contrato dentro del plazo de 14 días anteriormente referido, en supuestos de disconformidad sustancial con el producto solicitado, se le reembolsará el importe pagado previa verificación del estado de la mercancía, incluidos los gastos de devolución según lo dispuesto en el apartado a) del artículo 120 RDL 1/2007. Será imprescindible para hacer efectiva la devolución que los productos se encuentren perfectamente embalados. En caso de que los productos resulten dañados debido a un embalaje inapropiado, no se admitirá la devolución. El cliente deberá conservar el justificante de envío de la agencia de transporte encargada de la devolución hasta que, DESGUACES OLIVARES, acuse recibo de la recepción de la mercancía y estado de la misma.

El cliente será responsable de la disminución de valor de los bienes resultante de una manipulación distinta a la necesaria para establecer la naturaleza, las características y el funcionamiento de los bienes. En todo caso, el justificante de compra de los mismos será imprescindible para cualquier devolución.

El reembolso se realizará mediante la entrega al Cliente de una Tarjeta Devolución sin caducidad por la totalidad del importe del producto devuelto, que podrá ser canjeado tanto en el establecimiento físico como a través de la tienda online siempre que hubiera devuelto la mercancía antes del plazo anteriormente indicado; de lo contrario, DESGUACES OLIVARES no hará efectiva la Tarjeta Devolución sin caducidad por la totalidad del importe hasta haber recibido los bienes del cliente. Se considerará cumplido el plazo si efectúa la devolución de los bienes antes de que haya concluido dicho plazo. La entrega de la Tarjeta Devolución sin caducidad se efectuará, una vez verificado el estado de la mercancía, en el plazo máximo de 14 días naturales.
