§ 1 Geltungsbereich
Diese Allgemeinen Verkaufsbedingungen (im Folgenden: AGB) gelten für alle über eBay geschlossenen Verträge zwischen Akyol & Arning GbR (AllAboutAntik GbR), Inhaber/Vertretungsberechtigte: Akin Akyol & Liam Simon Arning, Adresse: Dreieichstr. 10, 64546 Mörfelden-Walldorf, E-Mail-Adresse: info@allaboutantik.com, Telefonnummer: +49(0)61053239919 (nachfolgend „Verkäufer“) und den Kunden (nachfolgend „Kunden“).
Die AGB gelten sowohl gegenüber Verbrauchern gem. § 13 BGB als auch gegenüber Unternehmern gem. § 14 BGB.
Der Kunde ist Verbraucher, soweit der Zweck der georderten Lieferungen und Leistungen nicht überwiegend seiner gewerblichen oder selbständigen beruflichen Tätigkeit zugerechnet werden kann. Dagegen ist Unternehmer jede natürliche oder juristische Person oder rechtsfähige Personengesellschaft, die beim Abschluss des Vertrags in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
Alle zwischen dem Kunden und dem Verkäufer im Zusammenhang mit dem Kaufvertrag getroffenen Vereinbarungen ergeben sich insbesondere aus diesen Verkaufsbedingungen, der schriftlichen Auftragsbestätigung und der Annahmeerklärung des Verkäufers.
Maßgebend ist die jeweils bei Abschluss des Vertrags gültige Fassung der AGB.
Abweichende Bedingungen des Kunden werden nicht akzeptiert. Dies gilt auch, wenn der Verkäufer der Einbeziehung nicht ausdrücklich widerspricht.
§ 2 Zustandekommen des Vertrages
Gegenstand des Vertrages ist der Verkauf von Waren.
Wird ein Artikel vom Verkäufer bei eBay eingestellt, liegt in der Freischaltung der Angebotsseite bei eBay das verbindliche Angebot zum Abschluss eines Kaufvertrages zu den in der Artikelseite enthaltenen Bedingungen.
Für das Zustandekommen des Vertrages gelten die eBay-AGB, insbesondere § 7, ein entsprechender Link befindet sich auf jeder eBay-Seite unten. Je nach Angebotsformat ist dort der Vertragsschluss wie folgt geregelt:

2. Stellt ein Verkäufer mittels der eBay-Dienste einen Artikel im Auktions- oder Festpreisformat ein, so gibt er ein verbindliches Angebot zum Abschluss eines Vertrags über diesen Artikel ab. Dabei bestimmt er einen Start- bzw. Festpreis und eine Frist, binnen derer das Angebot angenommen werden kann (Angebotsdauer). Legt der Verkäufer beim Auktionsformat einen Mindestpreis fest, so steht das Angebot unter der aufschiebenden Bedingung, dass der Mindestpreis erreicht wird.
3. Der Verkäufer kann Angebote im Auktionsformat zusätzlich mit einer Sofort-Kaufen-Funktion versehen. Diese kann von einem Käufer ausgeübt werden, solange noch kein Gebot auf den Artikel abgegeben oder ein Mindestpreis noch nicht erreicht wurde. eBay behält sich vor, diese Funktion in der Zukunft zu ändern.
4. Bei Festpreisartikeln nimmt der Käufer das Angebot an, indem er den Button "Sofort-Kaufen" anklickt und anschließend bestätigt. Bei Festpreisartikeln, bei denen der Verkäufer die Option "sofortige Bezahlung" ausgewählt hat, nimmt der Käufer das Angebot an, indem er den Button "Sofort-Kaufen" anklickt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt. Der Käufer kann Angebote für mehrere Artikel auch dadurch annehmen, dass er die Artikel in den Warenkorb (sofern verfügbar) legt und den unmittelbar nachfolgenden Zahlungsvorgang abschließt.
5. Bei Auktionen nimmt der Käufer das Angebot durch Abgabe eines Gebots an. Die Annahme erfolgt unter der aufschiebenden Bedingung, dass der Käufer nach Ablauf der Angebotsdauer Höchstbietender ist. Ein Gebot erlischt, wenn ein anderer Käufer während der Angebotsdauer ein höheres Gebot abgibt.
6. Bei vorzeitiger Beendigung des Angebots durch den Verkäufer kommt zwischen diesem und dem Höchstbietenden ein Vertrag zustande, es sei denn der Verkäufer war dazu berechtigt, das Angebot zurückzunehmen und die vorliegenden Gebote zu streichen.
7. Käufer können Gebote nur zurücknehmen, wenn dazu ein berechtigter Grund vorliegt. Nach einer berechtigten Gebotsrücknahme kommt zwischen dem Nutzer, der nach Ablauf der Auktion aufgrund der Gebotsrücknahme wieder Höchstbietender ist und dem Verkäufer kein Vertrag zustande.
8. In bestimmten Kategorien kann der Verkäufer sein Angebot mit einer Preisvorschlag-Funktion versehen. Die Preisvorschlag-Funktion ermöglicht es Käufern und Verkäufern, den Preis für einen Artikel auszuhandeln.
11. Wird ein Artikel vor Ablauf der Angebotsdauer von eBay gelöscht, kommt kein wirksamer Vertrag zwischen Käufer und Verkäufer zustande."
Kauf über die Funktion "Sofort-Kaufen" oder "Bieten"
Das Anklicken der auf den Artikelseiten enthaltenen Schaltflächen "Sofort-Kaufen" oder "Bieten" führt noch nicht zu verbindlichen Vertragserklärungen. Die Kunden haben vielmehr auch danach die Möglichkeit, ihre Eingaben zu prüfen und über den "Zurück"-Button des Internetbrowsers zu korrigieren oder den Kauf abzubrechen. Erst mit Abgabe der verbindlichen Vertragserklärung besteht diese Möglichkeit nicht mehr. Aus der Menüführung von eBay bei Durchführung eines Kaufes ergibt sich, durch welche Erklärung die Kunden eine Bindung eingehen und durch welche Handlung der Vertrag zustande kommt.
Kauf über den Warenkorb (soweit angeboten)
Durch Anklicken der auf den Artikelseiten enthaltenen Schaltfläche „In den Warenkorb“ werden die zum Kauf beabsichtigten Waren im „Warenkorb“ abgelegt. Im Anschluss wird den Kunden der „Warenkorb“ angezeigt. Ferner können sie über die entsprechende Schaltfläche in der Navigationsleiste den „Warenkorb“ aufrufen und dort jederzeit Änderungen vornehmen. Nach Aufrufen der Seite „Weiter zur Kaufabwicklung“ und der Auswahl bzw. Eingabe von Lieferadresse und Zahlungsart werden abschließend nochmals alle Bestelldaten auf der Bestellübersichtsseite angezeigt.
Soweit die Kunden als Zahlungsart „PayPal“ auswählen, werden sie zunächst auf ein Log-In-Fenster von PayPal geführt. Nach erfolgreicher Anmeldung bei PayPal werden sie auf die Bestellübersichtsseite bei eBay weitergeleitet.
Vor Absenden der Bestellung haben die Kunden die Möglichkeit, hier sämtliche Angaben nochmals zu überprüfen, zu ändern (auch über die Funktion „zurück“ des Internetbrowsers) bzw. den Kauf abzubrechen.
Mit Anklicken der Schaltfläche „Kaufen und zahlen“ erklären sie rechtsverbindlich die Annahme des Angebotes, wodurch der Kaufvertrag zustande kommt.
Kauf über die Funktion "Preisvorschlag" (soweit angeboten)
Bei der Funktion "Preisvorschlag" haben die Kunden die Möglichkeit, dem Verkäufer ein Gegenangebot zu unterbreiten, indem sie auf der Artikelseite die Schaltfläche "Preisvorschlag senden" anklicken, auf der folgenden Seite ihren Preisvorschlag eintragen, die Schaltfläche "Preisvorschlag überprüfen" anwählen und auf der nachfolgenden Seite die Schaltfläche "Preisvorschlag senden" bestätigen (verbindliches Angebot). An diesen Preisvorschlag sind die Kunden 2 Tage gebunden. Der Vertrag kommt zustande, wenn der Verkäufer den Preisvorschlag annimmt.
Die Abwicklung der Bestellung und Übermittlung aller im Zusammenhang mit dem Vertragsschluss erforderlichen Informationen erfolgt per E-Mail zum Teil automatisiert. Die Kunden haben deshalb sicherzustellen, dass die von ihnen hinterlegte E-Mail-Adresse zutreffend ist, der Empfang der E-Mails technisch sichergestellt und insbesondere nicht durch SPAM-Filter verhindert wird.
Korrekturmöglichkeit des Bestellvorganges
Die Kunden können ihre Eingaben vor Abgabe der Bestellung mittels der von eBay im Bestellprozess zur Verfügung gestellten und selbsterklärenden Mittel erkennen und korrigieren. Um eine Transaktion abzubrechen, betätigen sie die „Zurück“-Schaltfläche des Browsers, um wieder auf die Artikelseite oder zum eBay-Warenkorb zu gelangen. Im Warenkorb können die Kunden durch Änderung der Stückzahl die Menge der Produkte ändern bzw. durch Klick auf „Entfernen“ den Artikel aus dem Warenkorb löschen. Eingabefehler können auch durch Abbruch des Kaufvorgangs korrigiert werden.
§ 3 Vertragssprache und Speicherung des Vertragstextes
Die Vertragssprache ist deutsch.
Der Vertragstext wird vom Verkäufer nicht gespeichert. Über ihren eBay-Account haben die Kunden jedoch unter „Mein eBay“ die Möglichkeit, ihre letzten Bestellungen einzusehen.
§ 4 Lieferbedingungen und Vorbehalt der Vorkassezahlung
Der Verkäufer ist zu Teillieferungen berechtigt, soweit dies für die Kunden zumutbar ist.
Die Lieferfrist beträgt circa 3-5 Werktage, soweit nichts anderes vereinbart wurde. Sie beginnt- vorbehaltlich der Regelung in Abs. 4 - mit Vertragsschluss.
Der Verkäufer bietet grundsätzlich die folgenden Zahlungsarten zur Verfügung:

Google Pay
Apple Pay
Wenn die Kunden als Zahlungsmethode PayPal nutzen, werden sie im Bestellprozess auf die Webseite des Online-Anbieters PayPal weitergeleitet. Um den Rechnungsbetrag über PayPal bezahlen zu können, müssen sie dort registriert sein bzw. sich erst registrieren, mit ihren Zugangsdaten legitimieren und die Zahlungsanweisung an den Verkäufer bestätigen. Nach Abgabe der Bestellung im Shop fordert der Verkäufer PayPal zur Einleitung der Zahlungstransaktion auf. Die Zahlungstransaktion wird durch PayPal unmittelbar danach automatisch durchgeführt. Weitere Hinweise erhalten die Kunden beim Bestellvorgang.
Bei Bestellungen von Kunden mit Wohn- oder Geschäftssitz im Ausland oder bei begründeten Anhaltspunkten für ein Zahlungsausfallrisiko behält sich der Verkäufer vor, erst nach Erhalt des Kaufpreises nebst Versandkosten zu liefern (Vorkassevorbehalt). Falls der Verkäufer von dem Vorkassevorbehalt Gebrauch macht, wird er die Kunden unverzüglich unterrichten. In diesem Fall beginnt die Lieferfrist mit Bezahlung des Kaufpreises und der Versandkosten.
§ 5 Preise und Versandkosten
Sämtliche Preisangaben im Online-Shop sind Endpreise und enthalten die gesetzliche Umsatzsteuer. Die Preise verstehen sich, soweit nicht anders angegeben, zuzüglich anfallender Versandkosten.
Die Versandkosten sind in den Preisangaben im Online-Shop angegeben. Der Preis einschließlich Umsatzsteuer und anfallender Versandkosten wird außerdem in der Bestellmaske angezeigt, bevor die Kunden die Bestellung absenden.
Wenn der Verkäufer die Bestellung des Kunden durch Teillieferungen erfüllt, entstehen dem Kunden nur für die erste Teillieferung Versandkosten. Erfolgen die Teillieferungen auf Wunsch des Kunden, werden für jede Teillieferung Versandkosten berechnet.
Wenn die Kunden ihre Vertragserklärung wirksam widerrufen, können sie unter den gesetzlichen Voraussetzungen die Erstattung bereits bezahlter Kosten für den Versand zu ihnen (Hinsendekosten) verlangen.
§ 6 Zahlungsbedingungen, Aufrechnung und Zurückbehaltungsrecht
Der Kaufpreis und die Versandkosten sind spätestens binnen zwei (2) Wochen ab Zugang der Rechnung zu bezahlen.
Die Kunden können den Kaufpreis und die Versandkosten nach ihrer Wahl nur mit den vom Verkäufer angebotenen Zahlungsmöglichkeiten bezahlen.
Die Kunden sind nicht berechtigt, gegenüber Forderungen des Verkäufers aufzurechnen, es sei denn, ihre Gegenansprüche sind rechtskräftig festgestellt oder unbestritten. Sie sind zur Aufrechnung gegenüber Forderungen des Verkäufers auch berechtigt, wenn sie Mängelrügen oder Gegenansprüche aus demselben Kaufvertrag geltend machen.
Kunden dürfen ein Zurückbehaltungsrecht nur dann ausüben, wenn ihr Gegenanspruch aus demselben Kaufvertrag herrührt.
§ 7 Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung des Kaufpreises im Eigentum des Verkäufers.
§ 8 Gewährleistung
Der Verkäufer haftet für Sach- oder Rechtsmängel gelieferter Artikel nach den geltenden gesetzlichen Vorschriften, insbesondere §§ 434 ff. BGB. Die Verjährungsfrist für gesetzliche Mängelansprüche beträgt zwei Jahre und beginnt mit der Ablieferung der Ware, wenn der Kunde den Kauf als Verbraucher vornimmt. Wenn der Kunde Unternehmer ist, wird die Gewährleistungsfrist auf ein Jahr verkürzt.
Etwaige vom Verkäufer gegebene Verkäufergarantien für bestimmte Artikel oder von den Herstellern bestimmter Artikel eingeräumte Herstellergarantien treten neben die Ansprüche wegen Sach- oder Rechtsmängeln im Sinne von Absatz (1). Einzelheiten des Umfangs solcher Garantien ergeben sich aus den Garantiebedingungen, die den Artikeln gegebenenfalls beiliegen.
§ 9 Haftung
Der Verkäufer haftet den Kunden gegenüber in allen Fällen vertraglicher und außervertraglicher Haftung bei Vorsatz und grober Fahrlässigkeit nach Maßgabe der gesetzlichen Bestimmungen auf Schadensersatz oder Ersatz vergeblicher Aufwendungen.
In sonstigen Fällen haftet der Verkäufer– soweit in Absatz (3) nicht abweichend geregelt – nur bei Verletzung einer Vertragspflicht, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung die Kunden regelmäßig vertrauen dürfen (sogenannte Kardinalpflicht), und zwar beschränkt auf den Ersatz des vorhersehbaren und typischen Schadens. In allen übrigen Fällen ist die Haftung des Verkäufers vorbehaltlich der Regelung in Absatz (3) ausgeschlossen.
Die Haftung des Verkäufers für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit und nach dem Produkthaftungsgesetz bleibt von den vorstehenden Haftungsbeschränkungen und –ausschlüssen unberührt.
§ 10 Urheberrechte
Der Verkäufer hat an allen Bildern, Filme und Texten, die von ihm auf eBay veröffentlicht werden, Urheberrechte.
Eine Verwendung der Bilder, Filme und Texte, ist ohne ausdrückliche Zustimmung des Verkäufers nicht gestattet.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
Folgen des Widerrufs
Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Verträge zur Lieferung von Waren, die schnell verderben können oder deren Verfallsdatum schnell überschritten würde.
Verträge zur Lieferung versiegelter Waren, die aus Gründen des Gesundheitsschutzes oder der Hygiene nicht zur Rückgabe geeignet sind, wenn ihre Versiegelung nach der Lieferung entfernt wurde.
Verträge zur Lieferung von Waren, wenn diese nach der Lieferung auf Grund ihrer Beschaffenheit untrennbar mit anderen Gütern vermischt wurden.
Verträge zur Lieferung alkoholischer Getränke, deren Preis bei Vertragsschluss vereinbart wurde, die aber frühestens 30 Tage nach Vertragsschluss geliefert werden können und deren aktueller Wert von Schwankungen auf dem Markt abhängt, auf die der Unternehmer keinen Einfluss hat.
Verträge zur Lieferung von Ton- oder Videoaufnahmen oder Computersoftware in einer versiegelten Packung, wenn die Versiegelung nach der Lieferung entfernt wurde.
Verträge zur Lieferung von Zeitungen, Zeitschriften oder Illustrierten mit Ausnahme von Abonnement-Verträgen.
Verträge zur Lieferung von Waren, deren Preis von Schwankungen auf dem Finanzmarkt abhängt, auf die der Unternehmer keinen Einfluss hat und die innerhalb der Widerrufsfrist auftreten können.

Der Verkäufer weist auf die Online-Streitbeilegung für Verbraucher gemäß Art. 14 Abs. 1 ODR-VO hin: Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit, die die Kunden unter http://ec.europa.eu/consumers/odr/ finden. Hier kann man in die außergerichtliche Beilegung von Verbraucherstreitigkeiten aus Online-Verträgen eintreten.
Der Verkäufer ist zu einer Teilnahme an einem Verfahren zur Streitbeilegung vor einer Verbraucherschlichtungsstelle nicht bereit oder verpflichtet.
§ 14 Anwendbares Recht und Gerichtsstand
Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts. Wenn die Kunden die Bestellung als Verbraucher abgegeben haben und zum Zeitpunkt ihrer Bestellung ihren gewöhnlichen Aufenthalt in einem anderen Land haben, bleibt die Anwendung zwingender Rechtsvorschriften dieses Landes von der in Satz 1 getroffenen Rechtswahl unberührt.
Wenn die Kunden Kaufmann sind und ihren Sitz zum Zeitpunkt der Bestellung in Deutschland haben, ist ausschließlicher Gerichtsstand der Sitz des Verkäufers. Im Übrigen gelten für die örtliche und die internationale Zuständigkeit die anwendbaren gesetzlichen Bestimmungen.
Der Vertrag bleibt auch bei rechtlicher Unwirksamkeit einzelner Punkte in seinen übrigen Teilen verbindlich. Anstelle der unwirksamen Punkte treten, soweit vorhanden, die gesetzlichen Vorschriften. Soweit dies für eine Vertragspartei eine unzumutbare Härte darstellen würde, wird der Vertrag jedoch im Ganzen unwirksam.

§ 1 Scope of application
These General Terms and Conditions of Sale (hereinafter: GTC) apply to all contracts concluded via eBay between Akyol & Arning GbR (AllAboutAntik GbR), Akin Akyol & Liam Simon Arning, Dreieichstr. 10, 64546 Mörfelden-Walldorf, info@allaboutantik.com, +49 (0) 61053239919 (hereinafter "Seller") and the customers (hereinafter "Customers").
The GTC apply both to consumers pursuant to section 13 BGB and to entrepreneurs pursuant to section 14 BGB.
The Customer is a consumer insofar as the purpose of the ordered goods and services cannot be predominantly attributed to his commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding the contract.
All agreements made between the Customer and the Seller in connection with the purchase contract are based in particular on these Terms and Conditions of Sale, the written order confirmation and the Seller's declaration of acceptance.
The version of the GTC valid at the time the contract is concluded shall apply.
Deviating terms and conditions of the Customer shall not be accepted. This shall also apply if the Seller does not expressly object to their inclusion.
§ 2 Formation of the contract
The subject of the contract is the sale of goods.
If an item is placed on eBay by the Seller, the activation of the listing page on eBay constitutes a binding offer to conclude a purchase contract under the conditions contained in the item page.
For the conclusion of the contract, the eBay terms and conditions apply, in particular § 7, a corresponding link can be found at the bottom of every eBay page. Depending on the offer format, the conclusion of the contract is regulated as follows:
"§ 7 Offer formats and conclusion of contract
2. if a seller places an item in auction or fixed-price format using eBay services, they submit a binding offer to conclude a contract for this item. The seller determines a starting or fixed price and a period within which the offer can be accepted (offer period). If the seller sets a minimum price in the auction format, the offer is subject to the condition precedent that the minimum price is reached.
3. the seller can additionally provide offers in the auction format with a buy-it-now function. This can be exercised by a buyer as long as no bid has been placed on the item or a minimum price has not yet been reached. eBay reserves the right to change this function in the future.
4. in the case of fixed-price items, the buyer accepts the offer by clicking on the "Buy it now" button and then confirming it. In the case of fixed-price items for which the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking on the "Buy it now" button and completing the payment process immediately afterwards. The buyer can also accept offers for several items by placing the items in the shopping cart (if available) and completing the immediately following payment transaction.
5. in the case of auctions, the buyer accepts the offer by submitting a bid. Acceptance is subject to the condition precedent that the buyer is the highest bidder at the end of the bidding period. A bid expires if another buyer submits a higher bid during the bidding period.
6. in the event of premature termination of the offer by the seller, a contract is concluded between the seller and the highest bidder, unless the seller was entitled to withdraw the offer and cancel the existing bids.
7. buyers can only withdraw bids if there is a justified reason for doing so. After a justified bid withdrawal, no contract is concluded between the user, who is again the highest bidder after the end of the auction due to the bid withdrawal, and the seller.
8. in certain categories, the seller can add a price suggestion function to their offer. The price suggestion function enables buyers and sellers to negotiate the price for an item.
11. if an item is deleted from eBay before the end of the listing period, no effective contract is concluded between buyer and seller."
Purchase via the "Buy it now" or "Bid" function
Clicking on the "Buy now" or "Bid" buttons on the item pages does not yet lead to binding contractual declarations. Customers still have the option of checking their entries and correcting them or canceling the purchase using the "Back" button on the Internet browser. This option is no longer available until the binding contract declaration has been submitted. eBay's menu navigation when making a purchase indicates the declaration by which the Customer enters into a commitment and the action by which the contract is concluded.
Purchase via the shopping cart (if offered)
By clicking on the "Add to shopping cart" button on the article pages, the goods intended for purchase are placed in the "shopping cart". The "Shopping cart" is then displayed to the Customer. They can also call up the "Shopping cart" via the corresponding button in the navigation bar and make changes there at any time. After accessing the "Continue to checkout" page and selecting or entering delivery address and payment method, all order data is finally displayed again on the order overview page.
If Customers select "PayPal" as the payment method, they will first be taken to a PayPal log-in window. After successfully logging in to PayPal, they will be redirected to the order overview page on eBay.
Before submitting the order, Customers have the option of checking all details again, changing them (also using the "back" function of the Internet browser) or canceling the purchase.
By clicking on the "Buy and pay" button, the Customer declares its legally binding acceptance of the offer, whereby the purchase contract is concluded.
Purchase via the "Price proposal" function (if offered)
With the "Price proposal" function, Customers have the option of submitting a counter-offer to the Seller by clicking on the "Send price proposal" button on the item page, entering their price proposal on the following page, selecting the "Check price proposal" button and confirming the "Send price proposal" button on the following page (binding offer). Customers are bound to this price proposal for 2 days. The contract is concluded when the Seller accepts the price proposal.
The processing of the order and transmission of all information required in connection with the conclusion of the contract is carried out by e-mail, in part automatically. Customers must therefore ensure that the e-mail address they have provided is correct, that the receipt of e-mails is technically ensured and, in particular, that it is not prevented by SPAM filters.
Possibility to correct the order process
Customers can recognize and correct their entries before submitting the order using the self-explanatory means provided by eBay in the ordering process. To cancel a transaction, they press the browser's "Back" button to return to the item page or the eBay shopping cart. In the shopping cart, Customers can change the quantity of products by changing the number of items or delete the item from the shopping cart by clicking on "Remove". Input errors can also be corrected by canceling the purchase process.
§ 3 Contract language and storage of the contract text
The contract language is German.
The contract text is not saved by the Seller. Customers can view their last orders via their eBay account under "My eBay".
§ 4 Terms of delivery and reservation of advance payment
The Seller is entitled to make partial deliveries, insofar as this is reasonable for the Customer.
The delivery period is approximately 3-5 working days, unless otherwise agreed. It begins - subject to the provision in paragraph 4 - with the conclusion of the contract.
The Seller generally offers the following payment methods:
Credit card or debit card
PayPal
Google Pay
Apple Pay
If Customers use PayPal as their payment method, they will be redirected to the website of the online provider PayPal during the ordering process. In order to be able to pay the invoice amount via PayPal, they must be registered there or first register, legitimize themselves with their access data and confirm the payment instruction to the Seller. After placing the order in the store, the Seller requests PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. Customers will receive further instructions during the ordering process.
In the case of orders from Customers with a place of residence or business abroad or if there are justified indications of a risk of non-payment, the Seller reserves the right to deliver only after receipt of the purchase price plus shipping costs (reservation of prepayment). If the Seller makes use of the reservation of prepayment, he will inform the Customer immediately. In this case, the delivery period shall commence upon payment of the purchase price and shipping costs.
§ 5 Prices and shipping costs
All prices quoted in our online shop are gross prices, final prices including statutory sales tax and do not include shipping costs.
(2) If the goods offered are used items, antiques or collectors' items, taxation shall be in accordance with § 25a UstG (German VAT Act) differential taxation.
If the Seller fulfills the Customer's order by making partial deliveries, the Customer shall only incur shipping costs for the first partial delivery. If the partial deliveries are made at the Customer's request, shipping costs will be charged for each partial delivery.
If Customers effectively revoke their contractual declaration, they can demand reimbursement of costs already paid for shipping to them (shipping costs) subject to the statutory requirements.
§ 6 Terms of payment, offsetting and right of retention
The purchase price is due immediately upon conclusion of the contract. If the due date for payment is determined according to the calendar, you will be in default by failing to meet the deadline. In this case, you shall pay us default interest at a rate of 5 percentage points above the base rate for the year if you are a consumer. We may charge entrepreneurs default interest at a rate of 9 percentage points above the base rate.
Customers may pay the purchase price and shipping costs at their discretion using only the payment methods offered by the Seller.
Customers are not entitled to offset against claims of the Seller unless their counterclaims have been legally established or are undisputed. They are also entitled to offset against the Seller's claims if they assert complaints or counterclaims arising from the same purchase contract.
Customers may only exercise a right of retention if their counterclaim arises from the same purchase contract.
§ 7 Retention of title
The delivered goods remain the property of the Seller until the purchase price has been paid in full.
§ 8 Warranty
We are liable for material defects or defects of title in delivered items in accordance with the applicable statutory provisions, in particular §§ 434 ff. BGB (German Civil Code). The limitation period for statutory claims for defects is two years for new goods and begins with the delivery of the goods. If you are an entrepreneur, the warranty period for new goods delivered by us is 12 months. For used goods, the warranty period for consumers is reduced to one year; for entrepreneurs, the warranty period for used goods is excluded.
Any Seller's warranties given by the Seller for certain items or manufacturer's warranties granted by the manufacturers of certain items shall apply in addition to the claims for material defects or defects of title within the meaning of paragraph (1). Details of the scope of such warranties can be found in the warranty conditions which may be enclosed with the articles.
§ 9 Liability
The Seller shall be liable to the Customer in all cases of contractual and non-contractual liability in the event of intent and gross negligence in accordance with the statutory provisions for damages or compensation for futile expenses.
In other cases, the Seller shall only be liable - unless otherwise regulated in paragraph (3) - in the event of a breach of a contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the Customer may regularly rely (so-called cardinal obligation), limited to compensation for foreseeable and typical damage. In all other cases, the Seller's liability is excluded, subject to the provision in paragraph (3).
The Seller's liability for damages resulting from injury to life, body or health and under the Product Liability Act shall remain unaffected by the above limitations and exclusions of liability.
§ 10 Copyrights
The Seller has copyrights to all images, films and texts published by him on eBay.
Use of the images, films and texts is not permitted without the express consent of the Seller.

§ 12 Statutory right of withdrawal for consumers

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us, Akyol & Arning GbR (AllAboutAntik GbR), Dreieichstr. 10, 64546 Mörfelden-Walldorf, info@allaboutantik.com, +49 (0) 61053239919 , of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
You can also electronically complete and submit the model withdrawal form or another unequivocal declaration on our website www.allaboutantik.com . If you make use of this option, we will send you a confirmation of receipt of such a withdrawal without delay (e.g. by e-mail).
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
Consequences of revocation
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
Contracts for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded.
Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
Contracts for the delivery of goods if these have been inseparably mixed with other goods after delivery due to their nature.
Contracts for the supply of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered no earlier than 30 days after conclusion of the contract and the current value of which depends on fluctuations in the market over which the entrepreneur has no influence.
Contracts for the supply of sound or video recordings or computer software in a sealed package if the seal has been removed after delivery.
Contracts for the delivery of newspapers, magazines or periodicals with the exception of subscription contracts.
Contracts for the supply of goods whose price depends on fluctuations in the financial market over which the trader has no control and which may occur within the withdrawal period.

§ 13 European dispute resolution for consumers
The Seller refers to the online dispute resolution for consumers in accordance with Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which Customers can find at http://ec.europa.eu/consumers/odr/ . Here you can enter into an out-of-court settlement of consumer disputes arising from online contracts.
The Seller is not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board.
§ 14 Applicable law and place of jurisdiction
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the Customers have placed the order as consumers and have their habitual residence in another country at the time of their order, the application of mandatory legal provisions of this country shall remain unaffected by the choice of law made in sentence 1.
If the Customers are entrepreneurs and have their registered office in Germany at the time of the order, the exclusive place of jurisdiction is the registered office of the Seller. Otherwise, the applicable statutory provisions shall apply to local and international jurisdiction.
The contract shall remain binding in its remaining parts even if individual points are legally invalid. The ineffective points shall be replaced by the statutory provisions, if any. However, if this would constitute an unreasonable hardship for one of the contracting parties, the contract as a whole shall become invalid.
