Pricing
Prices quoted are UK £ Sterling and Euro's including VAT. We reserve the right, without prior notice, to vary any advertised prices on the web site, price lists or literature. We reserve the right to amend prices where the buyer has requested a variation to the standard product. Prices are exclusive of all transportation costs which will be charged to the buyer at the chosen rate at the time of supply.
Payment Methods
Credit Cards – We accept Mastercard, Visa, Switch, Solo, JCB and Delta payments. No surcharge is made on these cards, a card issuer's authorisation is required before goods are shipped. This authorisation is obtained automatically from the payment gateway as soon as an order is placed. At this point full payment for goods is debited from the credit card.
Cheque - Please make sure that all cheques are made payable to Creative Upgrades. Goods will be shipped on receipt of the cheque clearing and if the product is in stock.
Availability of goods you order
If we have insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by us from your credit card will be re-credited to your account and we will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order.
Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment.
We will not be obliged to offer any additional compensation for disappointment suffered.
Cancellation
Any order which has been accepted may not be cancelled by the buyer, unless we are informed by writing and cancellation is accepted in writing to Creative Upgrades. On products which have been specially designed or built to the customer's specifications or on services of any kind, a cancellation charge will be made up to the value of the original order.
Delivery
We make every effort to ship credit authorised orders received before 3pm Monday through Friday, the same day they are placed but makes no guarantee. Therefore, all delivery options apply to the shipment of in-stock items that are credit approved and verified by 3pm. This means that if you order a product and select a specialised shipping method, your order will ship via that method as soon as it clears our order processing. We may need to contact you to provide additional information to ship your order and thank you in advance for your co-operation. The majority of shipments from us are insured and shipped via a recognised carrier.
Warranties
Goods found to be defective at the time of delivery must be notified to us within 3 days of the date of delivery. We will repair, replace or refund at our own discretion any goods found to be defective within 12 months of the date of delivery provided that the goods have been installed, operated and maintained within the manufacturer's recommendations.
The warranty does not apply where the product has been subjected to misuse, neglect, accident or exposure to environmental conditions not specified by the manufacturer or where the product has been modified or repaired by anyone other than the manufacturer. Failure by the buyer to pay any sum owing will render the warranty null and void.
The buyer is responsible for returning the goods to us and is responsible for shipping, handling, insurance charges, tariffs, import charges and taxes and we will return the repaired or replaced goods free of charge. Should the buyer request any other means of shipping, involving additional charges, the buyer will be responsible and billed for those charges.
we shall not be under any liability for any damage or loss arising or said to arise from the use of any of our products.
Return Policy
No returns will be accepted without prior consent from Creative Upgrades who upon request will supply to the Buyer a Returns Authorisation Number (RAN). The RAN number can be obtained from our tech support department, details are located on the contact page.
All returns must have a Return Authorisation Number; (RAN) marked clearly on the return shipping-label.
• Goods being returned as faulty but where no fault is found may incur a handling charge.
• Goods returned for credit must be in saleable condition and complete with all manuals, components and undamaged original packaging, any software seals (if applicable) must not be broken.
• Damaged or incomplete goods shall not be credited.
• Goods that have been specifically made, modified or purchased for the buyer may not necessarily be returned but could incur a restocking fee which will be quoted before the goods are accepted for return.
• Returns will only be accepted from the buyer and not from the buyer's own customers or from the users of the goods.
Damage or loss in transit
In the event of non delivery the buyer should advise us in writing within 3 days for UK buyers and 7 days for overseas buyers of placing the order. In the event of shortage the buyer should advise us in writing within 3 days for UK and 7 days overseas of receipt of the delivery. If damaged goods are received the receipt should be signed damaged and the Seller notified in writing immediately. If this is not adhered to it may result in your claim being invalid. Please refuse parcels delivered to you in damaged condition.
Specifications
All descriptions, illustrations, specifications and dimensions are approximate and are intended to present a general guideline as to the goods therein. If our description of the goods varies from the Manufacturers then the Manufacturers shall take precedence. We do not accept any responsibility for damage, injury, loss or expense resulting from variations in the Manufacturer's data or specification or from curtailment or cessation of supply following such variations.
Copyright and Trademarks
No part of any of our publications may be reproduced, stored or transmitted in any form or by any means without the written approval from Creative Upgrades. It is acknowledged that all trademarks and trade names mentioned in any of our publications or web site are the property of their respective companies/owners.
Title
Title of goods sold on the invoice does not pass to the buyer until we have received payment in full for the goods. If the risk and title of the goods has passed to the buyer and the goods are subsequently returned to us for whatever reason, the risk of the goods will not pass from the buyer to ourselves until the goods are signed for by an authorised, employed representative of Creative Upgrades.
Exclusion of Liability
We shall not be under any liability whether in contract, tort or otherwise and whether or not resulting from the negligence of Creative Upgrades or that our employees, servants or agents, in respect of goods delivered or for any damage or loss resulting from use of goods.
Governing Law and Jurisdiction
This contract shall be governed by English Law and the English Courts shall have exclusive jurisdiction to settle any dispute arising from this contract.

Without in any way reducing or affecting your statutory rights, We make no representations or warranties either that the information in or accessible via this website is accurate, complete or current, nor of any other kind, express or implied, with respect to this website or the products, information, materials or content including, without limitation warranties of merchantability and/or fitness of any product for a particular purpose. In addition, the buyer shall ensure that all details contained within the order are correct and no liability for any error or inaccuracy shall lie with Creative Upgrades.
All guarantees for products are provided by the manufacturers and are subject to terms contained therein. You are reminded to complete all warranty cards/documents upon receipt of goods where appropriate.
Except as expressly stated in this website and, except for liability for death or personal injury to the extent only that it is caused by or arises from the negligence of ourselves and to the fullest extent permitted by law, neither Creative Upgrades nor any of its directors, employees, affiliates or other representatives will be liable for damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages being consequential damages not within the contemplation of the parties at the time the contract was made, loss of data, income or profit, loss or damage to property and claims of third parties arising out of or in connection with the use of this website or the information, content, materials or products included on this website.
Changes to this agreement
Creative Upgrades reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
