We would advise you to read this Agreement carefully as it guides your use of the Hatton's Model Railways Websites - www.eHattons.com, www.Hattons.co.uk and Ebay Seller Account - (the 'Websites'). By continuing to use the Websites you are agreeing to the terms set out below. If you have any questions about the Terms and Conditions, please do not hesitate to contact us.
These Terms and Conditions are applicable to the usage of the Websites and all transactions for the sale of goods made through the Websites. These Terms and Conditions do not affect your statutory consumer rights. We may change these Terms and Conditions at any time. Any changes will take effect on the date they are posted on the Websites.
1. Provision of Websites Service:
The Websites are owned and operated by Hatton's Model Railways Ltd (Company Number: 5131251), ('Hatton's Model Railways') whose registered office is at 364-368 Smithdown Road, Liverpool, L15 5AN, UK, VAT number - 163 7710 60. All products that are offered on these Websites are offered by Hatton's Model Railways, which will be the contracting party for any order that you place.
2. Buying Online: Terms and Condition of Sale on the Websites:
2.1 Product Details and Pricing
The prices for goods displayed for sale on the Websites are inclusive of VAT. Where additional charges are made for delivery, they are displayed at checkout.
Although we endeavour to ensure that all pricing and delivery information on the Websites is accurate, errors may occur and goods may be mispriced. If we discover a pricing error we will not be liable to provide you with that product at the stated price, provided that we have contacted you before the order has been dispatched. We will contact you and ask you whether you wish to cancel your order or permit us to continue with the order at the correct price. We reserve the right to cancel your order and will refund you the amount already paid for that product.
We reserve the right to adjust prices, offers, products and specifications of products on the Websites at our discretion at any time. We reserve the right to withdraw any goods from the Websites at any time. We will not be liable to you or to anyone else for withdrawing goods from the Websites.
The images you see depend on your monitor’s display and colour capability and may vary as a result. We are therefore unable to guarantee that the pictures of the products you see are an accurate representation of the actual items.
2.2 Ordering
All orders made by you through the Websites are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or anyone else in those circumstances. After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note that this email is an acknowledgement and is not an acceptance of your order. The order is only accepted when we send you an email notifying you that we have despatched the order to you or notifying you when a product will be available to collect at the shop (if applicable).
Your order represents an offer to us to purchase a product. Hatton's Model Railways cannot accept your order until you have paid for it in full (including applicable delivery charges) and it has been dispatched. Once you have completed an online purchase, if we are able to accept your order, we will send you an email confirming that the goods ordered have been dispatched to you, unless we have notified you that we do not accept your order or that you have cancelled it in accordance with our returns policy. It is at the point of dispatch that a contract will be made between us for you to buy and us to sell the products that you have ordered from us.
You can access details of your order and any previous orders by logging in to your account once you have registered. Please see FAQ’s for information on how to register.
We reserve the right to cancel the order if:
A product fault or an error in the product description has been identified (see 2.1 above)
We are unable to obtain payment (see 2.2.3 below)
We have insufficient stock to fulfill your order (see 2.2.4 below)
We do not deliver to your area (see 2.3 below)
2.2.3 Payments
Payment can be made by most major credit or debit cards. Payment will be debited from your account shortly before dispatch of the goods to you.
You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment we will not accept your order and we will not be responsible for any delay or non-delivery. We are not obliged to inform you of the reason for the refusal.
We are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.
2.2.4 Availability
Due to high demand, there may be certain situations where items become unavailable. If this happens we will inform you by email if any items you have ordered are unavailable. Please note we do not charge your credit or debit card for items not sent to you.
2.2.5 Pre-Ordering products from www.eHattons.com or www.Hattons.co.uk
Whilst we endeavour to supply enough products to meet demand, it is possible that certain products may sell out before they arrive due to their popularity. Pre-order restrictions for individual products will be confirmed when adding to your basket.
Products available to order in advance will have a button labelled ‘Pre-order’ instead of ‘Add to cart’.
Delivery charges for Pre-ordered items:
Pre-ordered items will be treated as separate deliveries and be subject to individual delivery charges displayed in the checkout. As we do not know the weight of the product when pre-ordered, we will inform you of the delivery charge before we take payment and dispatch the order to you.

In the event of our delivery charges changing we will endeavour to make you aware of these changes.
If you change the delivery destination of your pre-order, this may have an impact on the delivery charge.
Amending my pre-order
Details of all orders including pre-orders can be viewed through Your Account. Only Pre-orders that have not been despatched can be amended or cancelled.

2.3 Delivery Information

Please note bulky items/orders may trigger an additional charge to send it to destinations outside of the mainland UK. In this case you will be contacted to confirm the final amount.
2.3.1 Change of delivery address
Once you have placed an order then you cannot change the address details online. Please see the FAQs for more information.
2.3.2 Delivery Status
If you have not received your order or it is late please contact us. We will use our reasonable endeavours to ensure that the estimated delivery times are met but we cannot accept any liability for late deliveries which are due to circumstances outside of our control. However, if the ‘Guaranteed Next Day’ service has been requested and the order does not come within this time, we will refund you the difference between this service and the standard parcel service.
Once the goods have been received by you, all risk of damage to, or loss of, the goods shall pass to you. If you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.
2.4 Online Shopping Cancellation
Right to Cancel
You have the right to cancel your order up to 7 days from point of ordering. Contact us by email using this form to request this. Please note that if your order has already been dispatched, we will request that your order is returned prior to a refund being offered. Please see returns policy below for more details.
Our policy is to ensure that you are satisfied every time you purchase an item from www.eHattons.com. If you are unhappy with an item, please return it to us within 28 days of the date on the dispatch note that accompanies your order. Please ensure that you have taken reasonable care of it, the product is in an unused state, it is complete with original packaging and it has all of its original components.

3. Limitation of Liability
3.1 In respect of the Content that is available on the Site, Hatton's Model Railways will use its reasonable endeavours to resolve faults. You agree that www.eHattons.com and www.Hattons.co.uk will not be liable for any losses (other than damages for death or personal injury resulting from Hatton's Model Railways's negligence) you may incur as a result of your use or non-use of that Content.
3.2 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
3.3 Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller's agents or employees.
4. Privacy Policy
Hatton's Model Railways is committed to protecting the privacy of those using our Sites. The information that you provide about yourself to Hatton's Model Railways will only be used by Hatton's Model Railways Limited and related third parties in accordance with its Privacy Policy as set out below. We will treat all your personal information as confidential, and are committed to protecting your privacy. Any personal information which you provide to us is held in accordance with the Data Protection Act 1998.
4.1 Personal Information
We require personal details such as your name, address, email, debit/credit card, product and order details so that we can process your order and administer your account ( including taking steps to prevent fraud). We do not hold any credit card information.
Hatton's Model Railways uses third parties e.g. delivery providers, to assist with this who have access to limited personal information needed to perform their functions but may not use it for other purposes.
Unless it is necessary to fulfil your order or an order enquiry (including the delivery of goods you have ordered) or you have signed up for our email newsletter, we will not provide your personal information (i.e. information you supply that identifies you) to any external third party without your consent, or unless we are required to so by law.
Ways in which we might use your information to fulfil your order may include passing it onto employees and agents of the Group to administer any accounts, deliveries, products and services and passing it on to a technical partner to carry out processing of your personal information on our behalf.
We never make your personal details available to companies outside Hatton's Model Railways for marketing purposes, although our representatives and agencies may hold your data so that your details can be kept up to date, your orders processed and emails sent on behalf of Hatton's Model Railways.
If you sign up for our email newsletter, we use the personal information we collect about you to send you email newsletters featuring the latest promotional news, product information and in store activity. This information is held in compliance with the Data Protection Act 1998. Our site's registration form requires users to give us their contact information (e.g. name and email address) in addition to some demographic information (e.g. postcode). If you request to receive information from Hatton's Model Railways, we will use customer contact information from the registration form to send you electronic newsletters or similar types of information.
By using our Websites, you consent to the collection and use of personal information by Hatton's Model Railways. If we decide to change our privacy policy, we will post changes on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.
4.2 Data Security
We endeavour to take all reasonable steps to protect your personal information. All the data collected by us is stored on a secure server however we cannot guarantee that any data sent over the internet is completely secure.
4.3 Unsubscribing
If at any time you want to know what information Hatton's Model Railways holds about you, please feel free to contact us and we will provide you with details of all the information we hold about you. If you want to remove the information at any time, please let us know and we will remove it straight away.

5. Technical
You should be aware that information and data may be automatically collected through the use of ‘cookies’. Cookies are small text files a Websites can use to recognise repeat users, allow us to observe behaviour, and compile aggregate data in order to improve our Websites and to target its advertising. Cookies do not attach to your system or damage your files.
6. Security Policy
The Internet is not a secure medium. However, we have put in place various security procedures as set out in this policy, including firewall security and password protection.
www.eHattons.com has its own secure server software that encrypts all of your personal information preventing it being accessed or read by any third party. Our privacy policy ensures complete privacy. We do not disclose your details to any third party unless it is necessary to fulfil your order or unless you have signed up for our email newsletter.
When registering an account with www.eHattons.com you will need to include your name and contact details, your billing address and any shipping address different to your billing address. Once entered these are encrypted and sent to our secure server where they are held as long as you have an account with www.eHattons.com. At any time you can modify your account details by clicking the 'Login' link on every page. This will take you to the 'My Account' page, where you can view your contact details, address book and order history. Please note, we do not store any credit or debit card information.
Remember:
Keep your account details and password a secret. As long as you are logged out at the end of a transaction you will have to use your password the next time you wish to make a purchase or make changes to your e-newsletter subscription.
Do not send credit/debit card details by email as this is not secure. Please use our secure order payment service in the online shop.
In the unlikely event of unauthorised card use please be sure to contact your card issuer immediately as per your contractual arrangement with them.

8. General
8.1 There is no specific time limit applying to your access and use of the site. However, www.eHattons.com reserves the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.
8.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.
8.3 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.
8.4 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.
8.5 English law will apply to this Agreement and both you and Hatton's Model Railways agree to submit to the non-exclusive jurisdiction of the English Courts. We are required by law to inform you that sales can be concluded in English only.
8.6 Waiver: No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
