Yes they were 40...but due to shrinkage and wear and laundering, we list the ACTUAL measurements of the items we list and sell. These size 40s were actually a 38" waist as was shown in photos. If you would kindly start a return, we will gladly refund you for the purchase price and shipping...whether you mail the item back or not. Thanks for your understanding...

Cute pair of shorts the seller gave me a great price for. These weren’t exactly the color I was looking for though. The seller did indicate that they were darker than what appeared in pictures. They were more of a maroon color and I needed red. I did not like the purplish color of them. Received in perfect condition and fast delivery too.
