  No response from seller since for weeks over a part eBay have told me has been delivered back to seller and still no refund. Messaged seller numerous times - with proof of eBay saying he has received my item. Awful and so unprofessional - will be doing more reviews on all platforms

  I understand your frustration, but you refused to pay duty. You opened case against me on eBay and turned out that case was closed in my favor. You are requesting refund for item which never been returned to me. If you wish accuse others first start from your own actions. If would pay the duty as you should according to current tax law, there would be no case at all.
