      Tobacco and e-cigarettes policy

      Items containing tobacco are not allowed on eBay.

      Policy overview

      E-cigarettes and their accessories, or items containing tobacco, are not allowed on eBay. The sale of tobacco is highly regulated, so we do not allow tobacco products to be listed.

      What is the policy?

      The following products may be listed:

      • Nicotine patches or nicotine gums 
      • Promotional items with tobacco brand logos, such as calendars, hats, and shirts
      • Tobacco seeds
      • Collectible packaging that's completely empty (no tobacco inside)

      The following or similar products are not allowed:

      • Nicotine pouches
      • Any item containing tobacco including, but not limited to, cigarettes, cigars, and loose tobacco
      • Herbal cigarettes or herbal tobacco (sometimes called nicotine-free or tobacco-free cigarettes or shisha)
      • Domain names or web addresses for websites that sell tobacco
      • E-cigarettes, e-shishas and related accessories

      Activity on eBay is required to follow this policy, the eBay User Agreement and all applicable laws, as well as respect the rights of third parties. If it doesn’t, eBay may take action consistent with applicable laws and the eBay User Agreement, and may even be legally required to do so. Such actions may include, as an example only: Removing the listing or other content, issuing a warning, restricting activity or account suspension.

      Why does eBay have this policy?

      Because selling tobacco is highly regulated, most tobacco items can't be sold on eBay. Be sure to follow all applicable laws, regulations, and our policies. For items that are not traditionally intended for use with tobacco, refer to our Drugs and drug paraphernalia policy.
