Extended Producer Responsibility for business sellers listing on eBay.fr

Extended Producer Responsibility (EPR) legislation is part of an Europe-wide initiative to protect the environment.

What you need to know

France’s law on Extended Producer Responsibility (EPR) is part of an EU-wide initiative that encourages recycling and promotes the Circular Economy.

To be EPR compliant in France, business sellers that sell to France-based buyers need to register with the competent Producer Responsibility Organisations (PROs or “eco-organismes”) and then add the Unique Identification Numbers (UINs) you received in your eBay listings before 31 May 2023.

From 31 May 2023, any listings that don’t meet up to 4 requirements (see below under ‘Get compliant’) will be either blocked on eBay.fr or eBay will re-invoice the recycling costs paid to the seller. To be compliant with the law, you’ll need to register with the PROs and then add all the required information to your eBay listings before 31 May 2023.

From now on

If you already have the EPR required information, you’ll need to add those UINs on your eBay listings alongside additional mandatory information that the PROs communicated to you. See a list of categories impacted by this law.

Or

If you don’t have the EPR information to input on your listings, you’ll need to register with the relevant Producer Responsibility Organisations (PRO) that manage the recycling of the items you sell, the recycling of their packaging, and the recycling of some of their specific components. You’ll need to then add this information to your eBay listings.

Get compliant

As announced last September, eBay and other online marketplaces are now required by law to ensure that all items you sell to France-based buyers comply with the EPR guidelines in France.

To be compliant, you’ll have to meet up to 4 requirements on each of your listings by providing the following information:

  • the Unique Identifying Numbers (UINs) corresponding to the category of the item, its components or its packaging,
  • on specific categories, the eco-contribution you pay for each item of this type sold on eBay,
  • on specific categories, the repair score of the item and
  • on specific categories (e.g. Large Electronics, Appliance, Furniture), the mandatory free of charge one-for-one take back of old items.

You’ll have to provide all required information in your eBay listings before 31 May 2023. Starting 1 June 2023, if your listings on eBay.fr are not compliant, eBay will take action by blocking their visibility on eBay.fr.
